My family has always been law enforcement. One member is a retired officer. I am proud of the deep and lasting relationships I have with many in the Glendale Police Department. That is why I am particularly proud to share two law enforcement endorsements with you. One is from the Arizona Police Association and the other is from the Fraternal Order of Police. In addition I received an unsolicited endorsement from a retired Commander of the Glendale Police Department.

I have known Joyce Clark since she first became a council woman.  She immediately jumped into her duties as a council woman full time. She continually met with the Police Department Staff on crime issues and held neighborhood meetings to bring neighborhood and district issues to the attention of city staff and police department.

She studied issues and asked very in-depth questions of all city staff to ensure every angle of the issue had been reviewed and it would be in the best interest of her constituents and the city as a whole.

I can honestly say that with my 36 years at the police department, I have never seen any councilmember more dedicated to representing her district and its citizens. She is truly amazing in her love for the city and her district and I, without hesitation, endorse Joyce Clark as councilmember for the Yucca District.”

“Very disappointed in The Glendale Star’s non-recommendation for the Yucca District Council nomination. In all other races, the paper gave clear reasons as to why the other positions and candidates were qualified for office and named the person whom they recommended. Not the Yucca district.  

For some reason The Glendale Star chose to state the candidates “are a classic dilemma of choice with no clear or substantive advantage between the candidates.”

That’s a bunch of baloney. They are different as night and day and The Glendale Star must be blind not to see that.  You’ve been writing for weeks about a number of problems Sam Chavira has incurred. He has provided very little, if any, support to the people of the Yucca district in his tenure. Because of that, he has received no financial backing for his race from the residents of the Yucca district. All of his support comes from special interests and unions. On the flip side, Joyce Clark’s campaign is based solely on donations from Yucca district residents who trust and believe in her.

Joyce Clark has been a person of action and will continue to work for the citizens of Glendale. I’d say there’s a vast difference between the two candidates. One understands all facets of the job and the other has no clue.

I could cite more reasons why Sam is not qualified but your paper and the Arizona Republic have done a better job over the past months. Four more years of Sam Chavira would be a disservice to the City of Glendale. We all know it and I still don’t understand why the Star couldn’t say it.”

“I will tell you why you should vote for Weiers and Clark by telling you that the fire department needs to stick to fighting fires and stay out of politics.

Before I start, I would like to say I have always supported the firemen and police of Glendale. Safety has always been my concern. However, when they push candidates like (Mark) Burdick and (Samuel) Chavira upon the community, it is time to take a second look at their candidates. The fire unions have put a lot of money into the elections in Glendale and look what we have gotten.

We have Councilmember Chavira, who sold the farm to Coyotes and put the city in debt. He spent city money to see the Pope in Washington; not in person, but on a screen. He has no district meetings with the voters, misses meetings and it seems the only time he talks is when salaries for firemen are on the agenda.

Mr. Burdick is not much better, since in 2012, the fire department was audited while under his watch. It was found that policy was broken in regards to procurement.

Lastly, if you read The Glendale Star’s interview with him last Thursday, you will see that he said he has to lie to win. If this is the best the fire department has to offer, the city will be in deep trouble if they are elected.”

“Sammy Chavira says to vote on his record. What record?

1. One meeting with his district voters in four years.

2. He, along with best buddy, Sherwood, gave money away to the Coyotes. That is why we have potholes in our streets.

3. He spends money on frivolous trips to Washington D.C. to see the Pope on a screen.

4. When the apartments on 75th and Glendale were condemned and people had nowhere to live, Sammy was not there to help.

5. He supports the fiestas, but when you want to know what the money went for, he never produces receipts.

6. He has missed more meetings than any other councilmember. Not that that is a great loss.

7. He supported the Cinco de Mayo fiestas, along with Jaime Aldama. Again, no receipts, but we did get vandalism to the tune of $50,000. He should be in the newspaper every day, demanding that people be arrested and that restitution be made. Not Sammy; those are his buddies’ kids.

8. Sammy is a planted fireman, who was asked to run to get more money for the fire department. He is all show, but no go.

Vote for Joyce Clark and get someone that will show up for meetings, get our streets fixed, get decent libraries in the Yucca District, and above all, will be a workhorse, not a show horse like Sammy.”

It has been 18 years and 77 days since the city’s pledge to build the West Branch Library.

This newspaper clipping is an old headline from 2000 when I won an election for my council seat. In that election I was the only elected official in the state to run as a write-in against an incumbent and to win.

Imagine my surprise last week when I received a call from the Star editor, Carolyn Dryer, telling me she had received a Letter to the Editor from former Councilmember Norma Alvarez who represented the Ocotillo district. She told me Alvarez has publicly asked me to consider running for the Yucca district council seat. I have been asked repeatedly by my former constituents of the district since 2013 to do so. The reasons they offer are various. They would express their appreciation of my accessibility, my problem solving of their complaints and my representation of their voice. For years I had resisted even consideration of their pleas. But no longer.

They have also expressed their frustration and disappointment in their current representative. He is inaccessible. In fact, he is often AWOL. They cite his flip-flopping on issues and the exorbitant amount of money he has spent on travel, especially on trips that they contend are not city business.

I will spend the next week picking up the phone and talking to Norma to listen to her reasons as to why I should run again. I will also talk to my family and close friends to hear their thoughts on the subject. It is not a decision to be made lightly for it requires a major time commitment. It requires councilmembers (such as I was) to spend weekends “doing their homework” as council material for consideration and discussion at workshops and meetings is usually provided on Friday afternoons. I have the stamina and the intellect but do I have your support?

I would like to hear from you – readers of my blog, many of whom live either in the Yucca district or live in Glendale. The answer I seek is not only do you think I should run but are you willing to give of your time and talents in my campaign? I cannot take on a major commitment such as this without your support. Here is an excerpt of an email I received this morning in response to Norma’s call for my running for the Yucca district council seat. “I read the article about you in the Glendale Star and I also read Norma’s editorial, endorsing you! I say YES, go for it!! The Yucca and Glendale residents deserve a councilmember like you who cares about the community.”

This much I promise. I will seriously think about it. I will talk to others. I will wait to hear from you. After that, I will make a decision and publish it on this blog. So the question is: Will Clark do it again?

Earlier today, March 27, 2015 I made a Public Records Request for information relating to an allegation that Assistant City Manager Julie Frisoni may have violated the state’s Conflict of Interest law. Before the close of business today I received the information I had requested. I want to publicly thank Darcie McCracken, Deputy City Clerk, for the excellent and immediate service I received.

The information I received begins with a letter dated February 11, 2014 sent by Frisoni to Michael Bailey, City Attorney and copied to Jim Brown, Director of Human Resources and to then City Manager Brenda Fischer. In her letter she stated that Councilmember Alvarez had been harassing her and creating a hostile work environment for a month. She stated, “This merchant (from Glendale) told our staff today that CM Alvarez told him that I was going to be fired because of my unethical dealings in relation to purchases from a company that my husband works for.” She went on to say, “My understanding is that she (Alvarez) is violating the council code of ethics, as well as the council code of conduct.” She asked for an immediate investigation to remedy the situation and to be advised of the next steps.

Two days later, February 13, 2014 Brenda Fischer sent an email to Frisoni and copied Jim Brown and Michael Bailey. Fischer indicated that after receiving a councilmember complaint she directed Bailey to “research this matter” and based upon Bailey’s review she considered the matter closed. She attached a memo from Bailey with his conclusions. Bailey’s February 13, 2014 memo said, in part, “From his (Shumway) job title, he does not appear to be involved with public sector sales. Based on this cursory review, I did not find any information to indicate that Mr. Shumway was involved with or benefitted from Glendale’s contracts with Insight Public Sector.” He went on to say, “We were not provided nor discovered any evidence suggesting a conflict of interest. Please note that this review was cursory in nature; a more formal review and opinion would require information that isn’t publicly available.”

Fischer’s and Bailey’s conclusions are troubling because of the perceived lack of due diligence by Bailey in investigating the allegation. He said, “On-line information indicates that Mr. Shumway is vice president, information systems-application development at Insight.” He stated, “Based on this cursory review, I did not find any information to indicate that Mr. Shumway was involved with or benefitted from Glendale’s contracts with Insight Public Sector.” As you can see, Bailey appeared to have done on-line research and used that as the basis of his legal opinion. There also seems to be a lot of CYA on Mr. Bailey’s part with words such as “my understanding is” and it “appears.” As any good “jail house attorney” knows, those are wiggle room words. However, a February 20, 2014 letter by Frisoni to Jim Brown and copied to Fischer and Bailey indicated that she was satisfied and stated, “I am satisfied with the current action that has been taken…”

Hold on…not quite so fast…On March 3, 2015, a year later, Councilmember Bart Turner sent an email to Mayor Jerry Weiers, Acting City Manager Dick Bowers, City Attorney Michael Bailey, Vice Mayor Ian Hugh and Finance Director Tom Duensing. Prior to voting on the issue of a payment increase in the Insight contract he asked for an explanation of, “it appears that the increase in the contract is significantly higher than the base ($138,000) without any explanation for what we receive for the additional expenditure.” He made clear that he was not accusing Frisoni of any conflict of interest. He then stated, “In reviewing the conflict of interest disclosure file at the City Clerk’s office I notice there is no non-conflict statement on file from Ms. Frisoni as there are for several other city employees who may have a perceived conflict of interest due to family or personal ties to city business.” There is the answer we were seeking. Ms. Frisoni did not file a Conflict of Interest Disclosure about her husband’s company bid on and securitization of a multi-million dollar contract from the city.

Three days later, on March 6, 2015, Frisoni asked for specific statements attesting to her non conflict of interest. Director of Finance, Tom Duensing specifically asked Chuck Murphy, Chief Information Officer if Frisoni improperly influenced the Insight Public Sector bid. Murphy attested to the fact that it did not occur. Duensing did not offer any assurance. Frisoni then sent their emails to the City Clerk’s office.

Apparently Bailey requested a statement from Frisoni. In response on March 11, 2015, she sent an email to Bailey. Her opening stated, “Pursuant to your request, I am providing information regarding my association with Insight…” It appeared that this email was requested by Bailey to tie up loose ends in an effort to counter and to satisfy Councilmember Turner’s observation that Frisoni never signed a Disclosure. As an addendum within Arizona Revised Statues, Chapter 8, Conflict of Interest there is a specific Disclosure form provided. To this day she has not signed one. She should have erred on the side of caution, given her position within the city’s senior management, of signing such a form. It’s a good thing that she didn’t sign one now and backdate it. We all remember a previous backdating by 4 councilmembers, Eggleston, Martinez, Frate and Goulet that resulted in indictments for them and City Clerk Pam Hanna…all of which were dismissed on a technicality.

Frisoni said over and over in her correspondence that she did not influence or interfere with the City’s bid process and that appears to be true. But it doesn’t answer the question of whether or not she gave advice on that specific bid process to her husband to be passed on to Insight’s bid team. That we will never know.

Frisoni, through her actions, probably earns a zero for ethics. Even though it seems apparent that neither she nor her husband immediately benefitted financially from a successful bid, that’s not the point. It’s a matter of doing the right thing even if no one notices or acknowledges it. In a situation offering even the slightest perception of conflict it would have been prudent of her to disclose that her husband works for a company involved in a very lucrative bid with the city. It would not have hurt anything and would have enhanced her ethical standing. Many people are of the opinion that’s just not her style.
