It has been 18 years and 60 days since the city’s pledge to build the West Branch Library.

The general assumption is soon Councilmember Sammy Chavira of the Yucca district in Glendale will be running for his council seat. There are all kinds of theories floating out there as to why he hasn’t pulled a nomination packet already. One is that is he stalling to make his campaign season as short as possible. That leaves less time for voters to take a critical look at his record or lack thereof. The other is that he is going through the hiring process to obtain a lucrative paying job at the new Tohono O’odham casino in Glendale. Hmm…this could prove problematical for him. Remember his ouster from the National Hispanic Firefighters Association (NHFA)? One of the urban legends is that Sammy and his buddies drove around in a golf cart during the event collecting all of the event revenues for themselves. It is known that NHFA made no money on the event and had to cover event expenses in excess of $12,000.

It’s a good time to look at his campaign pledges and his record of delivery. Sammy ran on 4 central campaign promises revealed in an October, 2012 campaign mailer:

  • “Too many sweetheart arena deals for out-of-state corporations have left us deeply in debt. Sam will prioritize public safety, education and public libraries and isn’t afraid to say no to special interests.” 

Sammy was the deciding yes vote on the $15 million dollar a year arena management agreement with IceArizona. The irony is that yes, IceArizona is an out-of-state corporation but many of its owners are Canadian. In addition on June 11, 2015 Sammy and recalled Councilmember Sherwood were the only two votes against voiding the costly $15 million dollar arena management contract with IceArizona. It appears Sammy’s agenda was to support his good buddy Sherwood and IceArizona. It seems as if Sammy wasn’t afraid to say no to special interests but rather he supported them wholeheartedly.

  • “Sam understands that good jobs and good schools go hand in hand. He will fight to fully fund Head Start, support education tax credits for our local schools, and make after school programs more curriculum based.” 

This is the biggest lie of the century. Local city councils have no control over local education. That is the job of local school boards. The council can be supportive of local schools but it cannot create policy for any local school. So why did Sammy use this? Many voters, but not all, are unsophisticated. They are busy with their lives and don’t follow school or city issues unless it directly affects them and their families. Did he fight to “fully fund Head Start,” a federal program? No. Did he support “education tax credits for our local schools,” either state or federal? No. Did he “make after school programs more curriculum based?” No.

  • “Sam will go to the city council to represent the people, not a particular ideology, because he knows that results are what’s important.”

Has Sam represented you? Unless you are a political junkie you couldn’t pick him out of a line up. He’s had one…just one… district meeting back in 2013. The only other scheduled district meeting was cancelled at the last minute. Have you ever met him? Talked to him about issues that concern you? I think not. If he knows that “results are what’s important,” why hasn’t he delivered any to the people of his district?

  • “No more sweetheart deals. The city needs to be a tough negotiator, making smart planning decisions that preserve Glendale’s future.”

Sammy’s entire term of service seem to be based on sweetheart deals. Apparent deals with recalled Councilmember Sherwood; apparent deals with the Tohono O’odham, supporters of his campaign in return for his support of the casino; apparent deals with the fire union, supporters of his campaign in return for his support of their agenda. Deals in support of his constituency…not so much.

Sammy Chavira made a lot of promises to the voters of the Yucca district. He didn’t deliver. He made a lot of promises to special interests. He did deliver. He made a lot of campaign promises to the voters of the district and he broke them all.

A comment received in response to my blog entitled Situational Ethics was that the commentator had talked to Councilmember Gary Sherwood who named me as the leaker to Darrell Jackson (reporter for the Glendale Star and original FOIA requester) of the infamous Sherwood email. Councilmember Sherwood has responded to the allegations publicly, most notably in Darrell Jackson’s article in the Glendale Star. Let’s see what Mr. Sherwood has to say for himself, “It is no secret that I was pushing for the Coyotes,” Sherwood said by phone. “At the time we had acting attorney and city manager and a deputy city manager that we were not trusting of.” That in and of itself, is an incredible statement. Sherwood and the rest of council had enough confidence in Dick Bowers and Nick DiPiazza to appoint them as Acting City Manager and Acting City Attorney, respectively. Bowers and DiPiazza had been given direction by a majority of council (Sherwood, Martinez, Knaack and Chavira) to execute the best possible management agreement for the city with IceArizona. Bowers and DiPiazza took their obligation to craft the best deal possible seriously. Bowers, in fact, had publicly stated that he was concerned about the management fee of $15 million annually and its impact on Glendale’s precarious financial situation. Apparently this did not sit well with Sherwood, et.al. No wonder Sherwood and crew were doing an end-run around Bowers and DiPiazza by meeting with the IceArizona attorney, Nick Woods, and negotiating the deal. More situational ethics.

Sherwood goes on to say, “All of the items discussed (at the meeting with Wood) were supposed to be posted on our website; they just got delayed in posting.” That is no excuse for divulging Executive Session material. Sherwood’s expectation that it would eventually be publicly posted was not a valid rationalization for his giving Executive session material to Woods. More situational ethics.

Sherwood explains his direction to Martinez to delete the email by saying, “That last line was damning to look at, it was just for information.” He goes on, “Manny had no personal e-mail account, that (to delete) was for his benefit. I just wanted him to be careful so I just suggested he delete it.“ If the email had been appropriate to begin with, there would be no need to instruct Martinez to delete it. More situational ethics.

Sherwood’s dismissive attitude is reflected in, “We have had so many things go to the AG and it is another thing for them to look at. I just don’t see anything becoming (sic) of it.” He may be the only person on the planet to feel this way. The allegations of Open Meeting Law violations are serious this time. He practically calls out the Attorney General’s Office as being ineffectual.

Lastly, Sherwood says, “…he feels that this is a personal attack and was upset with the way it is being handled.” Why? Because he wasn’t given advance notice that a complaint was being filed? Welcome to the world of politics.

It is no secret that Gary Sherwood’ ambition is to become the next Mayor of Glendale. After all, since he was elected as a councilmember he has repeatedly tried to assume that role usurping Mayor Weiers at every available opportunity. It is also no secret that he can be extremely arrogant and rude. It has been demonstrated numerous times in his manner of response to citizen public hearing comments at council meetings. For example, his reaction to citizen comments on the billboard issue was to dismiss their lack of knowledge on the issue and to berate the numbers of anti-billboard attendees.

Many find it creditable to believe that Sherwood lined up four votes for an approval of the IceArizona contract. There has been rampant speculation for over a year that he and Chavira traded votes. Chavira would vote for the management agreement if Sherwood would vote for the casino. Coincidentally, Sherwood who ran on a platform of opposition to the casino flip-flopped and came out in favor of the casino in August, 2013, after the vote on the arena management deal. Many also believe that Sherwood was taking the lead and personally negotiating the arena contract and side-stepping the responsibilities of Glendale’s senior management. At that time he made public statements in media interviews which he used to portray himself as taking the lead position.  Is it any wonder that his actions are now under scrutiny?

It’s also no secret that many have expressed concern that Sherwood may have used the same tactics to secure a very recent council majority vote (Sherwood, Chavira, Alvarez and Hugh) of support for the proposed Tohono O’odham casino. That meeting appears to have been choreographed by the same 4 majority councilmembers who voted in the affirmative. Did they collude prior to the meeting causing yet another Open Meeting Law violation? I don’t know but I suppose over time we will all find out. A spider’s web of deceit and deception seems to be the hallmark of this council – a notion troubling many Glendale residents.

Over the weekend one of the many emails I received asked questions about Acting Assistant Julie Frisoni’s role in the Early Retirement Program (ERP). What did Frisoni, at that time the Director of Marketing and Communications, know and when did she know it? The writer of the email, based on the information in the audit, asks why the marketing director was conveniently left out of any headlines in the paper.

A review of the external audit report page 22 states, “On August 19, 2009, the Arizona Republic requested information from the City regarding the ERP…” On the same page of the report it further states, “On May 21, 2010 the Arizona Republic made a second public records request for information on the ERP…” In an email dated August 26, 2009 from Pam Kavanaugh (at that time Assistant City Manager) to Alma Carmicle (at that time Director of Human Resources) with reference to the public information requests made by the Arizona Republic she states, “If it is Budget related Sherry can handle – if it is H.R. related you can handle. Please keep Marketing in the loop on what is occurring. Has the other information been released? Have the employees been notified?”

From the audit report (Frisoni was interviewed one time) it appears that Frisoni may not have known the details of the ERP until 5 months after its inception but she certainly knew the facts by August of 2009. She states in the audit report that the information she supplied to the media was based upon her reliance on information supplied by others such as Schurhammer, Kavanaugh and Carmicle. If nothing else, it appears that she could have been a conduit of disinformation to the media. City staffers continue to believe that as Director of Marketing and Communications, she participated in the weekly meetings of upper management. As a result of her presumed attendance at those weekly meetings they believe that she knew of the ERP from its inception and the disastrous results that ensued long before it became public knowledge. As City spokesperson the assumption can be made that she would have needed to know about potential negative news about the city in order to spin it in the most positive light possible. At times that may have required the omission of information. Why hasn’t the media questioned the level of her involvement? Perhaps it’s more convenient for them to overlook one of their own in the business. 

Will we ever know the truth, the whole truth and nothing but the truth? It’s doubtful. It looks like 4 staffers will take the fall while the roster of the unscathed continues to grow: Beasley, Kavanaugh, Lynch, Carmicle, Loeb, and Frisoni. Many Glendale residents feel that her appointment as Acting Assistant City Manager is a slap in the face because Frisoni was part of the regime at the time of extremely poor (and perhaps illegal) decision making. Residents are asking why some are made accountable yet others continue to skate? There are no answers here but perhaps we will get answers from the Attorney General’s Office some day.

On another note, the city council approved the hiring of Michael Bailey as the new City Attorney.  According to the media he left Surprise, AZ when he and the city could not agree on his compensation. Mr. Bailey previously worked for Glendale and has history as a result.

Lastly, city council held an Esession on August 4, 2013 after its workshop and guess what was on its agenda…again? Yep, the arena management deal. It could be a standard place holder for an Esession or it could signal that there is some issue still unresolved. This is the second time it’s been on an Esession recently. Makes you wonder, doesn’t it?
