This is the proposed casino’s reality. It’s not possible for a Yard House, Gordon Biersch, McFadden’s or Saddle Ranch Chop House at Westgate to offer these prices.

Fort McDowell prime rib July 2014You will not see prices like these at the Westgate restaurants for very good reasons: sales tax and regulatory costs. You see, these restaurants have to collect federal, state, county and Glendale sales tax. The Glendale portion of the restaurant sales tax is 3.9%. When state and county taxes are added the total rate is 11.2%.What sales tax does the proposed Tohono O’odham casino with its planned restaurants pay? Nada…zip…nothing.

The icing on the cake is that the Glendale city council just voted to make the temporary sales tax increase permanent…just another stake in the hearts of these restaurants.

Add to the unlevel playing field of all kinds of taxes paid by businesses in Westgate the myriad of federal, state and local regulations with which these businesses must comply. It eats into Westgate businesses’ profits to do so. As a sovereign nation the TO is not required to comply with federal, state, county or local regulations. What regulatory costs does the proposed Tohono O’odham casino bear? Nada…zip…nothing.

TV Channel 5 weekly runs a “Dirty Dining” segment with recent results of inspections of restaurants in Maricopa County. Have you ever seen a Tribal restaurant inspection review? Of course not. Tribal reservations are not subject to these kinds of inspections. They are not subject to federal (OSHA), state, county or local health, safety and welfare regulations because they are a reservation and have sovereign immunity…consider the reservation as a foreign country planted within Glendale. A call placed to the Maricopa County Department of Environmental Services revealed that it has no jurisdiction over tribal restaurants and the Indian tribes regulate themselves. What regulations are there to protect the health, safety and welfare of the casino’s workers and patrons? Nada…zip…nothing.

What do you bet one of the very first elements the Tohono O’odham (TO) will build is paved parking lots. Why, you ask? So they can undercut parking prices for Cardinals games, hockey games and other non-sporting events held at Glendale’s arena, less than a mile away. Is there anything that can prevent the TO from offering cheap parking? Nada…zip…nothing.

I can see it now…shuttle busses packed to the gills disgorging seniors coming from the Sun Cities and Youngtown, spending their time playing bingo and the slots, then partaking of a buffet lunch or dinner before being whisked back to whence they came, never seeing the light of day at Westgate or Tanger Outlets.

Recently I received over the Indian gaming transom some  reliable estimates of what the proposed TO casino is projected to earn in revenue. The numbers are astounding. The numbers offered are not carved in stone but are reasonable estimates provided by people who would know within the industry. Estimates provided are that a new casino in Glendale would earn between six hundred million dollars and seven hundred million dollars a year in gross revenue.

It is estimated that the Tohono O’odham’s net will be half that amount (50%) or three hundred to three hundred and fifty million dollars a year. The net amount reflects the subtraction of all costs associated with O&M as well as an amount of 1% to 8% of the tribe’s gross gaming revenue to the state. To put that in some kind of perspective, it is estimated the TO will net a million dollars a day. Think about that…a million dollars a day.

Which leads to the question of why do the 32,000 members of the TO Nation average an income of $8,000 a year as Chairman Norris testified, under oath, before the Senate Committee on Indian Affairs this past week, “Most of our reservation land is located in remote isolated areas and our population is one of the poorest in the United States with average individual incomes of just over $8000.” The Tohono O’odham have 3 casinos operating in southern Arizona. Their website says, “The Desert Diamond Casino, owned and operated by the Tohono O’odham Nation, provides three exciting entertainment venues in Southern Arizona: Desert Diamond Casino (Nogales Highway), Desert Diamond Casino (I-19 & Pima Mine Rd) and Golden Ha:san Casino (Why, AZ).” It goes on to say, “The mission of the casinos is to provide the means for a better quality of life for Tohono O’odham Nation and all people in Southern Arizona.” If the TO are netting even a portion of these revenue estimates from its three southern Arizona casinos, why is part of the net not distributed to the Nation’s members by the Tribal leadership to reduce the poverty rates of its 32,000 members?        

It is widely known that 4 Glendale councilmembers directed staff to negotiate with the Tohono O’odham and the results will be discussed at their August 5, 2014 workshop. Rumor has it that the city council has negotiated something in the neighborhood of $100,000 from the TO. That’s got to be a joke. If it turns out to be true, once again, Glendale’s city council will get snookered…this time by the TO…all the while congratulating staff for their work and patting themselves on the back.

They should demand…not ask…demand a 5% payment of the Tohono O’odham’s annual net revenue earned by all of the development placed on that site. It has a nice ring to it, doesn’t it? What does 5% equal? How about $15,000,000 a year? Doesn’t that number sound familiar? It’s the same amount the city must pay annually to IceArizona under the management agreement. It would certainly go a long way to relieving the tremendous financial pressure the city faces annually as a result of that payment to IceArizona.

Are Glendale residents willing to sell their souls and bear yet another financial burden for not only a token payment but for the TO’s highly inflated numbers of temporary construction jobs and low-paying service industry jobs? Is this city council while pandering to a small number of extremely vocal residents that desperate and gullible? Is this the best that we can expect from our city council?

On Tuesday, July 15, 2014 the Glendale city council held a special meeting. It was posted the required 24 hours in advance of the meeting but other than knowing that the topic would be the casino, the posting was generic. Let me make clear I oppose the proposed casino. I have from the first moment in 2009 when the Tohono O’odham (TO) announced they were coming until this day and beyond.

We now know why this special voting meeting was called. There was evident panic in the pro-casino ranks of Councilmembers Alvarez, Hugh, Sherwood and Chavira. The public cover (read excuse) they used for calling the meeting was that the Department of the Interior recently approved taking TO land into trust (blessing it as a reservation). What really has them steamed is that Mayor Weiers has been invited to testify before the Senate Committee on Indian Affairs about off-reservation gaming on July 23, 2014. It was a blatant, back room  attempt to make him toe the city line and support the proposed casino. That was the “gang of four’s” real agenda. There is another element that needs to be considered. The Primary Election. There is every possibility that the majority in favor of the casino could become the minority, especially if Alvarez loses her council seat (a distinct possibility).

There should be some real concern among the public about the orchestration of this special meeting. The four majority vote councilmembers obviously got together and orchestrated this charade. Everyone should be asking, just how much conversation was there between them and was any portion a violation of the state’s Open Meeting Law? They, to a person, repeated each other and called for a new council resolution rescinding Council Resolution 4246 and asking for a declaration of support for gaming on the reservation land.  They obviously were all on the same page and had decided in advance exactly what the strategy and outcome were to be.

It was evident that the four, as a majority, called for the meeting without consultation with the minority. There was obviously a deliberate lack of communication with the 3 minority voting councilmembers. Obviously they were not included in any discussion about this special meeting. In fact, Mayor Weiers stated that he was on vacation and no one bothered to check his schedule for his availability. Vice Mayor Knaack made it clear her attendance was “under protest” and Councilmember Martinez called the meeting “inappropriate.”

Mayor Weiers has the legal right to oppose the proposed casino before this Senate Committee as long as he makes it clear that his comments are personal and do not reflect the city’s newly adopted position.  I sincerely hope that he takes this opportunity to express in the strongest terms possible, the many reasons why this casino is not good for Glendale.

Mayor Weiers made it clear that he was not happy with the process that was occurring and he stated unequivocally that “what is happening is wrong.” He said the entire process was rushed and it was — but now we know why. He reminded everyone that council has a history of making bad decisions when it is rushed.

Vice Mayor Knaack agreed that the entire process was rushed and could have waited until council reconvened in August. Ahhh, but then the majority pro-casino contingent would not have had the opportunity to try to muzzle Mayor Weiers before he testifies before that Senate Committee. She believes that a casino within Glendale will destroy the voter approved Arizona gaming compact passed in 2002 and it will.

Councilmember Martinez said that the council actions could jeopardize any leverage the city might have with regard to negotiations with the TO. Vice Mayor Knaack expressed the same concern and asked, “Will the action today impact the city’s ability to negotiate the best deal possible with the TO?” That finally stopped “the four” and they acceded to going into Executive Session. Apparently whatever they learned from the City Attorney in that E Session was not persuasive enough to dissuade any of the predestined, determined and blind action of the four.

Two comments were made of note. Arthur Thruston, a Glendale Gadfly, said there was nothing wrong with the manner in which the TO had purchased the land. As a reminder, it was purchased by a shell corporation of the TO back in 2002 and kept secret for 7 years, until 2009. Thruston likened it to Intel or any other large corporation buying land before announcing their new location. OMG…Thruston needs to get real. It is not typical for a corporation to wait 7 years between its purchase and announcement.

Councilmember Sherwood again reiterated that all of the businesses in Westgate are just hunky dory at the prospect of the proposed casino. He used the analogy of a hamburger stand on a corner saying, when another hamburger stand locates nearby it creates synergy and each stand will have more business. That’s fine as far as it goes. What if both stands produced hamburgers that tasted equally well but the new stand sold its burgers for less – a lot less? Did it ever occur to him that if both hamburger stands produced hamburgers of equal quality and taste the public would always choose the cheaper product? Voila! Does that make the situation the Westgate area businesses face from the proposed casino clearer?

Predictably Resolution 4828 New Series passed by a vote of 4 to 3.  It has 3 elements: repeal of Council Resolution 4246; support for gaming on the TO land; and direction that this resolution is sent to the entire Congressional delegation. Alvarez, Hugh, Sherwood and Chavira in the affirmative. Weiers, Knaack and Martinez in the negative. Alvarez has finally paid back the TO for their independent expenditures on her behalf. Now they will owe her more in this election.

The seminal question is this: How can anyone possibly trust anything the TO agrees to in its negotiation with Glendale? They kept secret purchase of the land in Glendale for 7 years. They back stabbed their sister Tribes by flagrantly violating the Arizona gaming compact. If you are not dissuaded by their past actions, I have bridge in Brooklyn to sell to you.

This action by council has stirred me to act. I am writing a letter to the entire Congressional delegation repudiating this council’s Resolution. I encourage any reader who is dismayed by this council’s recent policy decision to take the time to write as well.  A trickle of opposition, when joined with one another, becomes a stream and eventually a mighty river. It’s time for Arizona’s delegation to learn there is a mighty river of opposition to the proposed casino.

I have written about the proposed Tohono O’odham (TO) casino and its impact on Glendale too many times to count. The other day a thought occurred to me. We all know that Glendale is in a financial mess. Its debt burden has prevented the construction of so many much needed facilities such as a western branch library and has caused the cuts in service to residents’ quality of life.

We often hear Councilmember Alvarez complain about service cuts and the on-going lessening of basic infrastructure maintenance. Yet she is all too willing to support the construction of the proposed casino in the name of jobs. Realistically the job numbers touted by the TO are highly inflated and everyone seems to ignore the stipulation that 25% of them must go to Native Americans.

Has anyone considered the financial impacts to a city already struggling financially? I think not.

Several years ago senior Glendale staff presented a cursory assessment of the financial effects of the casino. It was made clear that a new water treatment facility would be required to service the intense demand for water that would be created by the casino and its ancillary uses.  The construction of such a water facility is upwards of $70 million. Who would pay for it? Certainly not the Tohono O’odham. The persons paying the construction bill would be water ratepayers through an increase in water rates.

Then there is the issue of public safety. While a TO reservation would have its own tribal police to handle issues within the reservation it would be Glendale’s police and fire that would respond outside the reservation boundaries. At the very least, Glendale taxpayers would have to bear the costs of an increase in personnel and could experience delayed response times.

Lastly there are transportation costs. Streets adjacent to the reservation may need improvement to handle the increased traffic that will occur 24/7. There may be a need for upgraded traffic signals, signage and upgrades to the city’s Intelligent Traffic System.

For all of those who support the coming of the TO casino, do you still want the casino if it means that you have to pay more for your water provided by the city?  For all of those who support the coming of the TO casino, do you still want the casino if it means that public safety response times get longer as Glendale’s public safety personnel deal with a major traffic accident on adjacent streets or respond to a heart attack victim on the reservation? For all of those who support the coming of the TO casino, do you still want the casino if it means that instead of resurfacing or improving your street the money is used to improve or maintain streets to accommodate the increased traffic adjacent to the reservation?

You know, of course, that because of reservation status, the TO pay no taxes of any kind – no federal taxes, no state taxes, no county taxes and no Glendale taxes. If you were counting on increased sales tax revenue from the casino to offset these new financial burdens to the city’s General Fund, you can forget it. It’s not going to happen.

There are those like Councilmember Sherwood that believe Glendale can negotiate reimbursement for its added financial burden to support the casino from the TO. Do you really think the TO will shell out $70 million for a new water treatment facility or pay the ongoing costs of an increase in public safety personnel or pay millions for new or upgraded street improvements?

Even if a deal is struck, how can you trust people who violated agreements and the trust of their sister Tribes or kept secret its purchase of land for 7 years? If they renege on any kind of agreement with Glendale how will those who have complained about the costs of law suits feel about yet another law suit to get the TO to honor an agreement with Glendale?  

Please don’t regurgitate that the TO are required to give a small portion (8%) of their revenue to non-profits throughout the state. That presupposes that the TO will give their entire portion to non-profits in Glendale and ignore those in the Tucson area (site of their real reservation). Not going to happen. None of that money can go to Glendale’s General Fund to offset the new financial demands created by the proposed casino.

For every action there is an equal reaction. It’s the age old law of unintended consequences. While you may support the proposed casino because it will “create jobs,” are you willing to place further financial burdens on a city already under financial stress? Are you willing “to put your money where your mouth is” and to pay more for your water, deal with longer public safety response times and watch your streets deteriorate even further? I’m not.

On May 27, 2014 the Supreme Court issued a ruling on a tribal immunity case, Michigan v. Bay Mills Indian Community. Here is the link to their decision: http://www.scotusblog.com/case-files/cases/michigan-v-bay-mills-indian-community/

It was a narrow case with a decision rendered on one specific issue. In a five to four decision the Supreme Court held that Michigan’s lawsuit against the Bay Mills Indian Community to stop a tribal casino operating outside of Indian lands was barred by tribal sovereign immunity.

Its decision appears be limited to the specific facts involved in this case.  Tribes that rely on this decision to engage in off-reservation commercial activity now know that they may not be able to rely on the Bay Mills decision for broad immunity, especially if an aggrieved plaintiff has no other remedies available. 

The decision reinforces the loophole that states can sue tribes for illegal gaming activity on Indian land but they can’t sue them for the same activity on off-Indian lands. Whether and how this decision applies to principles of tribal sovereignty involving future off-reservation commercial activities remains open, and one area that the Court purposefully left open.  Indian Tribes throughout the country did not gain an outright win with the Court’s opinion.

Michigan remains able to deny a license for an off-reservation casino. If the tribe went ahead with the project anyway, Michigan still retains the right to sue tribal officials to stop the gaming activity and, if necessary, invoke its criminal laws.  In addition, any state can still seek a waiver to allow lawsuits for off-reservation gaming activity as part of their compact with a tribe regarding on-reservation gaming.

This decision does not speak to the unique Arizona v. Tohono O’odham situation. It’s effect upon current litigation is questionable at best. In other words, this decision does nothing to advance or deny either side’s position on the proposed casino in Glendale. It is still expected that Rep. Trent Franks’ bill, HB 1410, will be voted up or down in the US Senate this summer.

Lately I have been in a “take no prisoners mode.” Think of Peter Finch as Mr. Beale in the film, Network, when he screams, “I’m mad as hell and not going to take it anymore!” I am thoroughly disgusted with the lies and subterfuge offered on various Glendale issues masked in a guise of altruism and high-mindedness. Rather than advancing issues that serve the best interests of our community opinions and actions have degenerated into advocacy of personal agendas. Yes, I know “we all do it” and “it’s done all the time,” usually accompanied by an admonishment to be “realistic.” It’s time to call “a spade,” “a spade” and not the PC description of, “a hand-held implement with a sharp-edged, rectangular, metal blade and a long handle used to loosen or break up the upper strata of the earth.”

The Glendale Star is a perfect example. Newspapers once had the reputation of objectivity in their reportage. Like many other time honored values news objectivity has fallen by the wayside.  When it comes to the proposed Tohono O’odham casino the Glendale Star obviously supports it. It is no secret that its Editor, Carolyn Dryer, attended an Alvarez hosted pro-casino meeting as a like-minded individual. There were also TO representatives in attendance. Her editorial choices seem to clearly reflect her bias.

There is a referendum petition in circulation designed to put the recent council vote to reject US Representative Trent Franks’ HB 1410 on Glendale’s fall ballot. By the way, if HB 1410 successfully passes in the US Senate the TO’s proposed casino will die a righteous death. The defeat or passage of HB 1410 is more critical than the public realizes. Make no mistake. If HB 1410 passes there is sure to be more litigation.

The referendum effort is being led by Glendale resident Gary Hirsch, a former city council candidate. Mr. Hirsch’s position is well known as one of the Glendale citizen plaintiffs in a previous lawsuit against the Tohono O’odham’s (TO) proposed casino.

On April 24, 2014 the Glendale Star Editor Dryer published an opinion piece on the casino referendum issue written by Mike Kenny, its Web Editor. Mr. Kenny’s opinion piece is a puff piece signifying “nothing.” I guess if one cannot speak to the issue the next best course of action is to denigrate it.  He refers to the referendum effort and characterizes it as achieving “nothing.” He goes on to say, “Oh, and it’s (council vote) a non-stance that likely has zero implications. It’s highly doubtful our nation’s Senate – if this bill is ever heard – will take into account the opinion of a city that can barely decide what its opinion is.” Really? If that were the case why did Councilmember Alvarez and her minions work so hard to bring it to a council vote? They believe that rejection of HB 1410 by the city in which the proposed casino would be sited would indeed send a strong signal.

What about other personal agendas on this issue? Those councilmembers who hold a pro-casino position appear to have done so for purely personal reasons not because they believe it is in the best interest of Glendale (although they will proclaim so loudly and often). Councilmember Alvarez seems to be in “pay-back” mode. It’s her way of sticking it to councilmembers who she perceives as having “disrespected” her when she first came on board. It’s purely personal and the TO have taken advantage of her vindictiveness. Councilmember Chavira owes Alvarez and the TO big time for their support and endorsement of his candidacy. It appears that their bill has come due and he is making good on his debt. Councilmember Hugh’s pro-casino stance is in contradiction to his usual fiscal conservatism. It’s been heard his wife is driving his pro-casino stance. Water cooler opinion has it that Councilmember Sherwood who ran as an anti-casino council candidate lusts to become Glendale’s next mayor and is expecting substantial financial support from the TO in his run for that office.

So much for decision making in the best interests of already beleaguered city. After all, it’s just politics. Isn’t it time for Glendale residents to say, “They’re mad as hell, and not going to take it anymore?”

On April 24,2014 there is a report that petition signatures are being collected calling for a referendum on the city council’s vote to repudiate US House of Representatives Trent Franks’ bill, HB 1410. If passed it would create law that would stop the Tohono O’odham’s effort to build its proposed casino. I support this effort. As the crow flies, I live a scant mile from the proposed casino site. Neighborhoods that will be directly affected by the impact do not want the casino. In my informal poll 50% of the respondents do not support negotiating with the Tohono O’odham and 50% of the respondents do. I believe this is the most divisive issue in Glendale’s history.

Our national and local economies are still abysmal. Unemployment is still way, way too high. Every politician worth his or her salt is running on a platform of job creation. Is it any wonder that the Tohono O’odham (TO) inordinately exaggerate and emphasize job creation associated with the proposed casino as a major means of garnering public support for its plan? Of course not but they do so in a rather Pinocchio-esque form. Remember the job creation numbers come from a Tribe that kept its land purchase secret for 7 years. That alone should make people think twice about their assurances of job creation. It’s time to take a realistic look at the TO promised job creation numbers.

Of course the proposed casino will create jobs both temporary and permanent. The disagreement occurs over TO touted numbers versus reality. The TO has consistently claimed the creation of 6,000 construction jobs and another 3,000 permanent jobs. Their numbers are highly inflated and that is understandable given their history of truth telling and their zealousness to build this casino at all costs.

Let’s look at some other Tribal casino projects. In Lansing, Michigan the Sault Tribe of Chippewa Indians is constructing a $245 million, 125,000 square foot casino. The tribe says the number of construction jobs is a little over 700 with 1,500 permanent jobs. That is reality, not myth.

In California the Graton Rancheria Tribe is constructing an $800 million entertainment and gaming destination. It has created 750 construction jobs and expects 2,000 permanent jobs. That is reality, not myth.

It’s time for the TO to explain exactly how they arrived at a figure of 6,000 construction jobs and 3,000 permanent jobs. How many jobs in what industries? What methodology did they use to arrive at those numbers? If they used a research study that they commissioned then the numbers can be considered highly suspect. It’s too bad that someone like Elliot Pollack hasn’t done independent research on jobs gained versus jobs lost.

As for permanent jobs a more realistic assumption is in the 1,500 to 2,000 range. Of course, we all know because the TO has made it abundantly clear that 25% of those jobs must go to Native Americans.  There is absolutely no way to determine how many jobs will go to Glendale residents. It is reasonable to assume that many jobs will go to residents from the surrounding Metro area. While that’s a great prospect for other cities, it’s not so good for Glendale who will bear the brunt of costs associated with a casino in the town while losing out on the benefits of the “multiplier effect.”

The great majority of jobs at casinos can regularly be found on the Forbes list of worst paying jobs in America – including that of ‘gaming dealer.’ According to the 2007 National Compensation Survey compiled by the US Dept of Labor’s Division of Labor Statistics the median hourly wage for gaming service employees is estimated at $6.34 per hour with annual median earnings of $13,179. That is $2,000 above the 2014 Federal poverty level.

The unions are fully on board and have been one of the most public advocates for the proposed TO casino as visions of union construction jobs dance in their heads. Wait…Arizona is a right-to-work state. If the unions have a behind-closed-doors, back-slapping “understanding” with the TO about using union labor exclusively they better get it in writing. They might want to get the TO to waive sovereign immunity with regard to any contracts and possible breaches. They should never forget the lesson of the TO’s secret land purchase. They also need to look at what happened to union labor used on the Graton Rancheria Tribe’s casino construction. Initially union labor was used but was quickly replaced with out-of-state construction workers, largely non-union. Sometimes it pays to be careful what you wish for as the California unions on the Graton Rancheria project painfully learned.

The proposed TO casino will create temporary construction jobs and permanent jobs, as will other industries which do not require reservation or sovereign status and can develop according to Glendale’s existent General Plan for that area while generating new construction and sales tax. With the exception of the cluster services associated with gambling, studies consistently reveal that new businesses tend not to locate in areas allowing legalized gambling and pre-existing businesses will face added pressures that push them toward illiquidity and even bankruptcy. The proposed casino will act as a disincentive to other businesses that would otherwise locate in western Glendale resulting in the loss of future, good-paying jobs.

The benefits of economic development is overstated by the TO and its proponents who never account for jobs lost from businesses that fail or choose not to locate in west Glendale due to the all-encompassing predatory nature of casino capitalism.

That’s reality.

Recently the Arizona Republic started a new item, West Valley Sound Off. They are contacting West Valley elected to get their positions on issues of the day. Their first foray question was, “Do you support the development of this proposed casino? Why or why not?” Those from Avondale, Buckeye, Goodyear, El Mirage, Litchfield Park, Peoria, Surprise, Tolleson and Youngtown declined to answer. Not so with our brave, intrepid leaders in Glendale. Three of them did respond.

Councilmember Manny Martinez has consistently opposed the casino since it was first proposed in 2009. He gets it. He said, “I do not support the proposed Tohono O’odham reservation and casino. I am very concerned for Westgate’s well-being if the casino is opened. How do casinos attract customers? Cheap booze, cheap food, and the cost of rooms are minimal. At Westgate, we have hotels and restaurants that pay taxes and help us pay off our debts. If the reservation and casino come in, as a sovereign nation, they would pay no federal, state, county or city taxes. Governor William R. Rhodes of the Gila River Indian Community said, ‘We believe the Tohono O’odham Nation, with the assistance of the federal government, has disrespected the rule of law, the balance so carefully struck among Indian gaming tribes, our community, Glendale and every Arizonan.”

Then we have words, signifying nothing, from Councilmember Chavira. He doesn’t get it and he is not representing the majority sentiment of the residents of West Glendale and the Yucca district, who will feel the direct impacts of the proposed casino. He mimics the same, old, tired rhetoric that the Tohono O’odham have used ad nausea, “Yes, I do support the development of the proposed West Valley casino and resort. The benefits of the development will be significant not only for Glendale, but for the entire West Valley. Positive economic impacts such as job creation and an additional tourist attraction in our sports and entertainment district are among the benefits.” I’m sure he knows, uhmmm, well, perhaps he knows…that 25% of the jobs must be filled with Native Americans.

Lastly, Councilmember Sherwood responded. This is a guy who, less than two years ago, ran on a platform of opposition to the casino. Now, not so much. He did a flip-flop at a very recent council meeting voting with Councilmembers Hugh, Alvarez and Chavira to reject U.S. Representative Franks’ HB 1410 and to begin negotiations with the Tohono O’odham (TO). Many suspect his affirmative vote was pay back to Chavira for Chavira’s vote in support of the arena management deal. “Neither – I will support the project if the Tohono O’odham Nation can be treated as close to a private entity as possible and having some form of revenue stream into the city’s general fund. Additionally, infrastructure including any street improvements, public-safety agreements, et al. would have to be included and enforceable in federal courts. Thus far, in fact-finding sessions, the Nation appears to be very amenable to this. Businesses such as Westgate, Renaissance Hotel, Coyotes and Tanger Outlets, to name a few, are also in support of proposed project. The sports and entertainment district could very well capitalize on a project of this size if it meets the city’s criteria.” He appears to be back-pedaling as he straddles a very narrow  fence, by adding his list of caveats. His declaration that,” Westgate, Renaissance Hotel, Coyotes and Tanger Outlets…are also in support” is downright laughable. There has never been a declaration of public support for the proposed casino from these entities. Have you seen it? I haven’t. Remember when the possibility of losing the Coyotes as an anchor tenant at the arena loomed? Bar and restaurant owners were beside themselves and declared without 40 nights of hockey games they couldn’t make it. They are not going to support a casino that will draw customers away from them knowing that potential consumers will spend disposable income on gambling, subsidized meals and booze and cheap room rates. If they are so willing to commit financial suicide, let’s see them do it publicly. Not one representative of these entities went to the last council meeting when TO negotiations was on the agenda and expressed public support of the project. Sherwood had no public letters of support from these entities that he could read into the record that evening. It’s time for Sherwood to cease making declarations that may not be accurate. Just because he said it, doesn’t make it true.

The Glendale City Council meeting of March 25, 2014 was reminiscent of many meetings I attended. It was one of those marathon sessions, lasting well over 4 hours, attracting many public speakers. The council approved a contingency fund transfer of over $6 million for the arena management fee and accepted staff’s recommendation that retirees will now pay the full liability for their medical insurance. Curiously current city personnel will remain heavily subsided by the city (read, you, the taxpayer).

However, the two big issues were billboards along the Loop 101 and Bell Road and the resolution to officially rescind city support for U.S. Representative Trent Franks’ legislation, HR 1410.

One could see a sea of yellow t-shirts in support of allowing billboards adjacent to the Loop 101 and Bell Road. Jordan Rose of the Rose Law Group delivered a strong, and very, very long presentation on behalf of Becker Boards. Yet speakers against the proposal outnumbered those supporting 2 to 1. It was assumed by many that it was a done deal and would win approval. After all, Councilmember Sherwood had publicly announced that he had the four votes needed for its passage. Can you say, “blind-sided?” The ultimate vote was 5 to 2 against. Only Councilmembers Sherwood and Alvarez voted in favor of Becker Billboards.

Sherwood’s advocacy for the billboards may be more easily understood as one of the speakers questioned his support in terms of the campaign contributions he had received from the stakeholders. A quick pass of his campaign finance reports reveals at least $1,960 received from members of the Rose Law Group and another $1,720 received from members of the Becker family. Approximately 1/5 of his total campaign contributions came from these two entities.  

As a side note, seeing the large campaign contributions from fire unions, fire PACs and union firefighters in Sherwood’s campaign filings has piqued my interest. Look for a future blog that details how much money these fire union entities poured into Glendale’s last election cycle in 2012 and to whom. I suspect it will surprise us all except for the fire unions who probably know to the penny.

Councilmember Alvarez, on the other hand, cast a spite vote in favor of the billboards. After all, if her district must suffer their blight, why shouldn’t North Glendale suffer too?

The other hot issue was a vote by a majority of council to reject Representative Trent Franks legislation (HB 1410) to prohibit casino construction in the Phoenix Metro area after August of 2013. Council’s vote on this issue was much closer this time, 4 to 3, with Councilmembers Alvarez, Hugh, Chavira and Sherwood (perhaps as payback to Chavira) voting in the affirmative. The result of this congressional bill would be to stop the Tohono O’odham in their tracks. You can be sure it will result in another court battle. In the meantime court decisions are not yet settled in the 9th Circuit Court and in the Supreme Court.

Plain and simple, the Glendale City Council should not have done this. It is a slap in the face of a supportive bipartisan congressional coalition made up of the likes of Franks (R), McCain (R), Pastor (D) and others—virtually the entire Arizona Congressional delegation is in support of Franks’ legislation. The State of Arizona has a law on the books—the voter approved Gaming Compact of 2002. Since when can a city council pick and choose which laws it will uphold? It is a premature action that can result in futility should the court cases be resolved against the Tohono O’odham or Franks’ bill become law.

Mayor Weiers read a letter from Representative Franks expressing his disappointment with this council’s action and his pledge to continue to move this legislation forward. The Mayor also expressed concern that should the Tohono O’odham prevail the State Legislature will move to allow gambling state-wide, no holds barred. Many neighborhoods, state-wide, not just in the Phoenix Metro area, may become victims of new casino construction, not just by state tribes but by gaming interests throughout the country.

I, the former Yucca district councilmember, along with many, many Glendale residents, especially in the district affected, the Yucca district, urge the Gila River Indian Community and the Salt River-Pima-Maricopa Indian Communities to stay the course. Continue to fight this deception perpetrated by the Tohono O’odham on you, its sister tribes.

I urge Representative Franks to also stay the course. The 4 current councilmembers who voted to pass this resolution do not represent the majority — Glendale residents opposed to this intrusion. They are misguided–swayed by the promises made to them by the Tohono O’odham. Yet how can we trust a tribe that used deception to buy the land and keep it a secret for 7 years? How can other tribes trust the tribe that used deception and secretly was planning to build a casino while advocating for a state compact that promised no new casinos in the Phoenix Metro area? Anyone who relies upon the Tohono O’odham’s word after having seen their deceptions is a fool. It looks like we’ve got at least 4 fools on the Glendale City Council. Sigh…

March 18, 2014 was a “two-fer” in terms of council workshops. The morning session focused on the budget: General Fund budget balancing; Employee medical benefits; and fire staffing. The afternoon city council workshop also had 3 items of discussion: the Becker billboard request; a possible archery range at Heroes Park at 83rd and Bethany; and the Tohono O’odham casino.

I am going to discuss only one of those items here and now – the proposed Tohono O’odham (TO) casino. All of the other items will be covered in a subsequent blog.

In a prior meeting Vice Mayor Knaack requested an assessment of the impact of the proposed casino on the city and during the day’s discussion reminded staff of her original request that: staff (City Attorney Michael Bailey) bring back an assessment of the impact (fiscal and otherwise) of this proposed casino on Glendale; and that staff meet not only with the TO but with the tribes in opposition to the casino. Was Bailey too busy with his tablet and smart phone to pay attention because he fulfilled none of Vice Mayor Knaack’s request? He simply regurgitated former City Attorney Craig Tindall’s well-researched legal opinion on the matter. His actions could be construed as those of someone who is lazy and ill informed. He did not provide this council with Knaack’s original request: that of an assessment of the impact on the city.

Somehow or other the council discussion, at Councilmember Alvarez’ instigation (in person no less), moved to negotiating directly with the TO and opposing Franks’ bill. Chavira and Hugh immediately expressed their support. Mayor Weiers and Councilmembers Martinez and Knaack voiced their dissent. None of this was a vote, as council does not vote at workshop, but gives direction to staff through a majority support to move forward to investigate, plan and bring back information to be voted on in a council meeting.

Four councilmembers (a majority) gave direction to initiate negotiations with the TO and to express the city’s opposition to Congressional Representative Trent Franks’ bill, HR 1410. To what end no one knows because there are still lawsuits to be settled that will determine the proposed casino’s fate.

Councilmember Martinez, in opposition, quoted from a very eloquent article written by former Governor Rhodes of the Gila River Indian Community in the Arizona Republic on October 20, 2010.. The former Governor said, “There’s no literal translation in English that does justice to the tribal word, ‘himdag.’ As Governor of the Gila River Indian Community, himdag guides my every decision, my every action. Himdag, as passed down by our elders across hundreds of years, teaches us to respect for all things, including the value of a promise, abiding by the law and concern for the welfare of others.

Respect as a guiding principle feels old-fashioned in the 21st century, but it exists all the same – even when our community is compelled to sign its name to a lawsuit against the United States Department of the Interior.

You may have read about that lawsuit filed Spt. 16. You may have also read about Glendale’s lawsuit to stop the casino, filed this week. Out of respect, I believe that I must explain the reasons why my community to pointedly disagrees with Washington and with a southern Arizona sister tribe’s plan to build a casino on land they secretly bought in Glendale, 160 miles from their reservation headquarters.

My explanation can be summed up in a single sentence. We believe the TO Nation, with the assistance of the federal government, has disrespected the rule of law, the balance so carefully struck among Indian gaming tribes, our community, Glendale and every Arizonan.

At the crux of our lawsuit is clear evidence that the proper procedure for creating an Indian casino has been sidestepped. I’ll leave the legal wrangling to the lawyers, bit in the 21 months since our sister tribe surprised us with plans to build a casino on our aboriginal lands, our community has learned more than we would care to about legal loopholes, PR spin and shading the truth. The surprises have continues to come, and so have the disappointments especially where our sister tribe is concerned.

In the past, my community and the TO Nation have lived side by side and mutually benefited from our entwined cultures and interests. There’s no better example than the Indian gaming compacts ratified by Arizona voters in 2002. Proposition 202, supported by 17 tribes statewide, including the Gila River and TO communities, created a sound but delicate balance, a promise, that kept casinos out of urban neighborhoods, gave much needed revenue to the state and created an economic engine to lift every tribal community.

To see that balance upset and that promise broken – and to see one tribe use secrecy and legal maneuvering to benefit at the expense of every other tribe and our state – is difficult to comprehend, let alone stand for in silence.

Thus the Gila River Indian Community has taken our case to federal court. Our first goal is to force the federal government to apply federal gaming laws evenly. Never before has a tribe been allowed to “shop” for reservation land half a state away from its homeland, then open a casino on the newly created “pocket reservation.” That not only flies in the face of federal gaming law, but in the face of every Arizona’s vote for Proposition 202.

As for our sister tribe, I know our disagreement is temporary. Himdag has a place of supreme importance in their culture, too. I would like to believe that their leadership will rediscover their way soon enough. I believe we can achieve more together than apart and that greed should never be allowed to trump respect for all things.”

The deciding supporter of Alvarez’ plea was Councilmember Gary Sherwood. Mr. Sherwood can not have it both ways despite the rambling, confusing and often contradictory reasons for his decision. On one hand he says he still supports City Council Resolution 4246 that stated that the city is officially opposed to the TO casino.  It’s important to quote part of that resolution, “Whereas, the City believes that the Tohono O’odham Nation’s assertions and the basis upon which it makes these assertions are incorrect, poor public policy, in violation of the governmental rights, privileges, and authority of the State of Arizona, the County of Maricopa, and the City of Glendale, and are contrary to the best interests of the Citizens of the State of Arizona, the County of Maricopa, and the city of Glendale; and Whereas, the City of Glendale, consistent with the Indian tribes voicing opposition to the Tohono O’odham Nation’s application, opposes off-reservation gaming, including this current effort by the Tohono O’odham Nation to establish gaming on the Proposed Reservation Land, as contrary to the terms of Proposition 202 as presented to the people of the State of Arizona in 2002 and supported by, among other, the Tohono O’odham Nation.” Here is the link to Bailey’s (really Tindall’s legal opinion): http://www.glendaleaz.com/Clerk/agendasandminutes/Workshops/Agendas/031814-W03.pdf .

On the other hand, Sherwood then launched into a monologue stating, in essence, the TO casino will create “synergy” with Westgate and drive more business there. In a pig’s eye and he knows it. Subsidized food, drink and room rates at the TO proposed casino will undercut every restaurant, bar and hotel in the Westgate area. Despite his statement that he still supports opposition to the proposed casino and it will be “contrary to the best interest of the City of Glendale and of the citizens of the State of Arizona” he then supported moving forward with negotiations with the TO and opposition to Franks’ bill.  On one hand he says he opposes the casino because it earns not a penny of revenue for Glendale yet on the other, he is prepared to negotiate and facilitate their eventual presence.  His position is illogical yet he became the fourth councilmember needed to achieve consensus and direction.

Why? Sometimes things become clearer with perspective. Think back to the arena deal vote. Sherwood knew Weiers, Hugh and Alvarez were opposed to the arena deal and Martinez and Knaack already supported him and the deal. The vote was split, 3 to 3. He discovered those 5 members could not be dissuaded. Whether one agreed with or opposed their positions they had the principles of their conviction and could not be moved. He desperately needed that 4th vote of approval for the arena deal.

Who was left? Newly elected Sam Chavira — of course. Whispers of this scenario have circulated for months. If Chavira voted for the arena deal, in return Sherwood would support the casino. Is it true? I don’t know but it makes perfect sense and certainly seems to fit the known facts. Did each sell their souls? For what? Political back scratching? To be recognized in public hockey town halls as the saviors of the Coyotes? Reelection financial support from hockey and TO stakeholders with deep pockets?

But at whose expense? The citizens of Glendale locked into unsustainable arena debt of an estimated $27 million a year with a council unwilling to make the budget cuts that make the arena deal feasible? The Westgate area business owners who will suffer from unfair competition? The residents of West Glendale whose property values will decline with the advent of a casino while crime and traffic increases? The Westgate business owners who will suffer from unfair competition?  The Indian tribes who joined the State Compact in good faith? The voters of the State of Arizona presented with a plan to limit casino locations?

These politicians were just that –typical politicians, exemplifying the worst of the offices they hold. Sherwood delivered an irresponsible and dangerous signal to casino friends and foes alike. His flip flop on one of his campaign promises should be remembered when he runs for reelection. Given this, expect him flip flop again and to support the hated billboards proposed for North Glendale.  After all, he confessed that all of the fuss over the billboards was “baffling” to him and he was “pro-business.” There is no statesmanship here.

What exactly is in Representative Trent Franks’ bill, H.R. 1410? In the world of Congress it is short and sweet. Here is a link to the text of the bill: http://www.keepingthepromiseaz.com/.

H.R. 1410 specifically cites the 2002 voter approved state Gaming Compact which expires in 2027.The bill states that there was a promise to Arizona voters that there would be no new casinos in the state, especially within the Phoenix metropolitan area, other than those specifically granted within the Compact. It requires that there be no new casinos in Maricopa and Pima Counties. This stipulation covers the period from April 9, 2013 to January 1, 2027. That’s it. Nothing more. Nothing less.

This bill enjoys bipartisan support not only among the Arizona delegation but in Congress as well. It has passed the House of Representatives and has moved to the Senate. Its fate is unknown. It will be voted up or down or ignored in this session. If no action occurs it dies and will have to be reintroduced in the next session of Congress. If the midterm elections prove to be wildly successful for the Republicans there is a good chance for its successful passage.

The Tohono O’odham (TO) and their supporters are positively hyperventilating over this bill. If passed the TO simply cannot build in Glendale – certainly not until 2027 when the Gaming Compact is up for renewal by voters.

What many fail to realize is that the proposed casino is not in the hands of Glendale. We all await a decision from the U.S. 9th Circuit Court followed by a final clarifying decision by the U.S. Department of the Interior. Then there is the Supreme Court decision on the case of Michigan vs. Bay City on the issue of Tribal sovereign immunity. Don’t for a second believe that these decisions won’t be appealed – for they will. We are still years away from a final outcome.

Why all the posturing by the TO and their supporters right now? Could it be because the Gila River Indian Community and their sister tribes have ramped up their profile of late by advertising on TV and underwriting a letter of support by Mayor Weiers? They must be chagrinned to see the Gila River Indian Community award a grant to Glendale that is 10 times larger than the $40,000+ they awarded a month ago.

The drama will continue with both sides posturing and vying for the hearts and minds of Glendale residents. Yet the ultimate decision rests elsewhere.
