It has been 18 years and 27 days since the city’s pledge to build the West Branch Library.

Not only are we entering the intense portion of the national political season with the election of a new President but Glendale politics will soon heat up. Several have taken out nomination petition packets which are due in the City Clerk’s office between May 2, 2016 and June 1, 2016.

Current Mayor Jerry Weiers and mayoral contender Mark Burdick have already taken out nomination petition packets as have Vice Mayor Ian Hugh (Cactus district) and current Councilmember Ray Malnar (Sahuaro district) who recently unseated Gary Sherwood in a Recall Election. Neither of these current councilmembers, as of this date, faces a challenger. In the Yucca district current Councilmember Sammy Chavira has not taken out a nomination petition packet. Nor has anyone else.

On January 8, 2016 KJJJ radio aired interviews centered on the topic, “Is Glendale Bouncing Back?” It was a strange exercise as apparently Burdick had been interviewed by the station before talking to senior staff and Mayor Weiers and Vice Mayor Hugh. The consensus of senior staff and the Mayor and Vice Mayor is that Glendale has recovered but not completely. All felt there was more work to be done to achieve the holy grail of complete financial stability for Glendale. All believe Glendale is well on its way to doing so.

It was what mayoral candidate Mark Burdick said in this story that will trouble many. Burdick said the fire department needs more resources to reduce response times. The police department needs more detectives in north Glendale.” Despite the published fact that Fire Department response times have not increased in the past 5 years.

Everyone should be concerned that Burdick’s major agenda is throwing more money exclusively into the Fire Department. Burdick has acknowledged that the city is not in full financial recovery yet he is willing to take dollars…from somewhere…probably all other city departments…to throw to his favorite department…the Fire Department. What would one expect from a man who retired as Glendale’s Fire Chief? What else would one expect from a candidate who is counting on the tremendous financial and manpower support of the fire unions to try to capture the mayoral seat? He will owe them big time.

With regard to calling for more detectives in north Glendale Burdick is simply pandering to voter strength. It is no secret that the 3 north Glendale districts (Cholla, Sahuaro and Barrel) outvote the 3 south Glendale districts (Cactus, Ocotillo and Yucca) by a margin of 3 to 1. If he attempts to capture the majority of the voters in the 3 north Glendale districts he is going to have to promise them some goodies. Is it any wonder that he made a call for more detectives in north Glendale when more police personnel are needed throughout the city? It’s merely the first of what may be many goodies for north Glendale.

There is no doubt that every Glendale department is stretched thin as Glendale continues its path to full financial recovery. There is no doubt that every department has needs to be met. Allocating more money to the fire department must not occur at the expense of the many needs throughout Glendale.

The Fire Department and the Police Department must be thoroughly scrutinized under zero-based budgeting. Zero-based budgeting requires each department to begin with zero dollars and to justify the need for every dollar allocated to it. Explaining what dollars are needed and where they will be utilized provides openly transparent public knowledge to every Glendale taxpayer that must foot the bill.

Be careful of Burdick’s promises. His advisors, such as Julie Frisoni formerly embroiled in alleged shenanigans related to the $15 million dollar a year Coyotes contract, appear to be a very slick bunch not above promising those things that will garner him votes and using whatever dirty tricks are at their disposal. All signs point to a fierce fight for the mayoral seat and the fight has just begun…

Please note: Tom McCarthy very recently passed away. Tom had been a voice in Glendale for many years and was well known in our community. He was a first rate attorney and long-time advocate for downtown Glendale. He was a gentleman and most certainly, a scholar. He will be missed. My condolences to his wife, Diane McCarthy. I had planned to post this blog yesterday afternoon but then Paris. It just didn’t seem appropriate. Many people share their speculations with me. Lately, rumors and speculation abound about  Councilmembers Chavira and Aldama and yes, sadly…disgraced former Councilmember Sherwood.

There are no hard facts in this blog but rather a compilation of rumors and speculation melded together from a variety of sources. Let’s begin with the Sahuaro district. At this moment things have quieted down but don’t expect it to last for very long. Sherwood claims he will run for his Sahuaro seat again. That may be problematical for him. He has lost a great deal of support and previous donors to his campaign coffers are fading into the political mist. The fire union is frantically looking for someone to run against newly elected Sahuaro district Councilmember Ray Malnar. Don’t be surprised if a Phoenix Deputy Fire Chief, Larry Contreras, whose move into the Sahuaro district was publicly announced by Chavira, becomes their candidate of choice.

In the Yucca district voters will choose a councilmember on November 8, 2016. Expect events to heat up there as well. Rumors have it that current Councilmember Chavira will not run for reelection. Instead, there is speculation that the Tohono O’odham will hire him for a position perhaps as Marketing & Communications Director or Public Safety Director (he seems qualified for neither). It appears that Sammy’s support of the casino may have paid off for him big time. A competing camp believes that under the mentorship of Ruben Gallego, newly elected U.S. Congressman representing Arizona’s 7th District , Chavira may run for the State Legislature providing the fire union some representation in that body.

All of these rumors led me to do some speculating of my own. Now, imagine this scenario, Chavira and Aldama are very close…buddies. We know that Aldama wants to run for mayor so badly it hurts. Everything he does as a councilmember seems to be specifically designed for that goal. Right now Aldama is on a different election cycle. If he were to run for mayor he would have to resign from his council seat and he would no longer enjoy the power of incumbency to assist him. But what if he could stand for reelection in the same cycle as the mayor? With a little shuffling it could happen. Imagine his buddy, Chavira, giving Aldama a heads up that he is not running again way before he announces that publicly. Aldama, as Ocotillo district Councilmember, claims his residency in the Ocotillo district as required by law. But he has a perfectly good home in the Yucca district (where everyone believes he lives) and he could pull a nominating packet to run for the Yucca district council seat right now. If he were to win the seat it would put him up for reelection in 2020, the very same time the next race for Glendale’s mayor would take place.

If you live in the Yucca district and have always harbored the desire to run for city council, get ready. Without Chavria running, the seat will be wide open (even if Aldama decides to run for this seat). The next election is exactly a year from now. Call the Glendale city clerk and ask when nominating packets can be pulled.

They say that truth is stranger than fiction. If even a smidgeon becomes reality it will be a strange Glendale indeed. For political junkies it makes for interesting conversation.

Lastly, food for thought: People tend to gravitate to and associate with like-minded people. Over the coming months take note of just where Mark Burdick in his run for mayor is getting his support…Frisoni, Aldama, Chavira…hmmm…

On November 3, 2015 the voters of the Sahuaro district dealt a political death blow to Councilmember Gary Sherwood by voting for Ray Malnar to replace him. The unofficial vote total has Ray Malnar winning with 53.61%. There is no doubt that Sherwood caused his own demise. How?

Sherwood was elected in November of 2012. For three years his actions and votes have raised questions. One of the major centerpieces of his campaign was his strong opposition to the Tohono O’odham casino in Glendale. As a result of his position the anti-casino forces paid for independent expenditures supporting his run. He also ran pledging fiscal conservatism in managing the city’s arena. It didn’t take him long to renege on both elements of his platform.

Within a year of his first term he reversed his position on the casino and became its strongest advocate. When asked why, his answers were consistently vague and seemed to center around learning “new information.” When queried on what information and from whom, he never offered a clear and convincing explanation. There was also the nagging assumption by many that he had swapped his positive vote of support for the casino with Councilmember Chavira’s positive vote of support for the IceArizona arena management deal.

Sherwood ran supporting his constituency’s opposition to continuing the practice of exorbitant financial payments to operate the city’s arena. Inexplicitly he advocated for the IceArizona management deal at a cost of $15 million a year. His actions in connection to this support gave rise to an alleged complaint (eventually dismissed) to the Arizona Attorney General’s office regarding his divulging of executive session information. He seemed to have developed a pattern of deliberately supporting big money interests over the voices of his constituents. It was a pattern soon to be repeated.

In the matter of Becker Billboards Sherwood was a prime advocate for their interests while he once again ignored his constituency. It left a bitter taste with his constituents and now they were becoming alarmed about his lack of support for their views. His failure to connect with his constituency became an issue of contention with the proposal to sell the Foothills Branch Library. He failed to notify them of meetings on the issue usually until the day before a scheduled public meeting. He bragged about a luncheon meeting he had arranged with the Kathleen Goeppinger, President of Midwestern University, proposed buyer of the library.

He seemed to be very proud when he declared in a council workshop meeting he had met privately with one candidate under consideration as Glendale’s new city manager, Brenda Fischer. Many people were astounded that he would have done such a thing. He was her strong advocate and after she was hired he seemed to receive preferential treatment not only from Fischer but from her inner circle, including soon-to-be Assistant City Manager Julie Frisoni. It was seemingly obvious that Sherwood and his coalition of councilmembers had the ear of Fischer and her inner circle while those who opposed Sherwood and his positions were frozen out.

Sherwood appeared to be needy…he wanted to be recognized as a “major player,” locally and regionally.  He seemed to revel in the attention he received from Anthony LeBlanc, et.al, when they were seeking approval of their arena contract. After the management contract was signed he was observed lurking about at Coyote Town Hall meetings trying to catch LeBlanc’s attention until he was recognized and praised. Did he know observers reported members of IceArizona not only ignored him after securing the contract but apparently they ridiculed him as well?

When it came to Becker billboards that stakeholder group had contributed significantly to Sherwood’s campaign and so, he seemed to reciprocate by advocating for them. Again, Sherwood seemed to ignore his constituency’s overwhelming opposition to the billboards in favor of those who generously contributed to his campaign coffers. Then there are the countless recitations by many on the 4th floor of city hall who heard Sherwood’s declarations that he was the “real” mayor of Glendale. Many city employees thought he was arrogant and dismissive of them.

The nail in the proverbial coffin was his apparent belief that he was above the law. He accumulated at least 6 driving citations in a relatively short time period and then failed to follow through in fulfilling his responsibilities for those actions eventually leading to a state-wide warrant for Failure to Appear. This issue was resolved only after it was publicly reported that he was caught with his hand in the proverbial cookie jar. In a recent press release he admitted to using city funds to rent a vehicle while driving on a suspended license and pledged to reimburse the city.

After all of his purported foibles, who wanted Sherwood to remain in office? The largest supporter of keeping Sherwood in office was Phoenix Firefighters Local 493 Fire PAC Committee (responding to the bidding of its sister Glendale union) having contributed $14,000 to an Independent PAC called Citizens for Safety and Education run by a long time fire union activist, Mike Colletto. Between October 2 and October 14, 2015 the independent committee spent $11,412.96 advocating for Sherwood’s retention. By the way, per usual, Sherwood was late in filing his latest campaign expense report. He raised nearly $40,000 ($39,810.30). Of note, that’s twice the amount that his opponent, Ray Malnar, raised ($18, 800). Sherwood’s big money contributors were: Mark Becker – $3,000 on 9/9/15; the Tohono O’odham – $6,250 on 10/8/15; Nick Wood (an attorney for IceArizona) – $1,500 on 10/8/15; Jason and Jordan Rose (Becker billboards was/is a client) – $1,000 on 10/17/15; and members of the Molera Alvarez political consulting group – $1,000 on 10/21/15 and 10/22/15. Let’s not forget PAC contributions, much of it union money, totaling $28,000:

Why has Gary Sherwood become the first councilmember ever successfully recalled in Glendale’s history? Despite the tremendous fire union financial and manpower support as well as the financial support of “big money” interests, Sherwood ignored the voices of his constituency and demonstrated that he was apparently more willing to support the interests of those who contributed generously to his campaigns. You can be sure Sherwood will place the blame on “outside interests” such as casino opponents but Sherwood was the architect of his own political demise by making choices that seemingly benefitted him in the short term while ignoring long term consequences. He died politically by a thousand, tiny cuts self inflicted as he made choices that seemed to benefit only himself. Sherwood has no one to blame but Sherwood. He made his choices and has been made accountable for them by his district’s voters. In commenting on his loss Sherwood said he plans to run again in November of 2016. Albert Einstein once said, “Insanity is doing the same thing over and over again and expecting different results.”
Sometimes…every once in awhile…the good guys do win…

On September 20, 2015 former Glendale Fire Chief Mark Burdick pulled a packet to begin the process to run for mayor of Glendale. That sparked many asking if I would run for mayor. The answer is “no.” I am really enjoying my retirement as well as my new found freedom to comment on Glendale’s issues.

Personally, Mr. Burdick is gregarious and affable. He is a nice man but I know a lot of nice people who do not possess the qualities one would expect of a mayor.

There are two major factors about Burdick that voters should consider a year from now when the election occurs. One is the history of his past associations. Burdick was in the Beasley/Fischer-Frisoni-Tindall inner circle.  Apparently Beasley left as city manager while he could for surely he would have been terminated for his alleged favoritism, i.e, allowing Alma Carmichel, former HR Director, to telecommute from Mississippi; and allowing Art Lynch, former Finance Director, to profit handsomely as a consultant after he left Glendale’s employ. Fischer left as city manager after her actions of publicly berating the Glendale Chamber of Commerce President and in a retaliatory move requested councilmember emails. Tindall and Frisoni were employees who allegedly used their positions to further the goals of the Coyotes ownership group in its dealings with the city. Also Burdick appears to support Councilmember Sherwood who is facing recall on November 3, 2015. Burdick continues to maintain a relationship with Frisoni for he hired her to design the marketing package for his brand new company. In fact, I still remember the evening at a function at Westgate when Burdick and Frisoni lobbied me to choose Tindall as Glendale’s Interim City Manager. There is an old adage that you are judged by the company you keep.

The other major issue is the question of the effectiveness of Burdick’s leadership while he was Glendale’s Fire Chief. It appears that Burdick ceded his vision and leadership to the Glendale Fire Union. Fire union employees are sprinkled throughout the organization in decision making positions and other positions of power. Burdick seemed powerless to rein in the fire union’s agenda and goals. He didn’t seem to have the backbone to stand up to them and to advance an agenda that was good for all of Glendale – not just the fire union. Burdick, as fire chief, would have occasional but regular lunch meetings with councilmembers. I always felt as if I were listening to the fire union’s emissary. Several times I suggested that Burdick had to gain control of his department and I would get silence and this seemingly “deer in the headlights” look from him. His leadership skills are in doubt.

Make no mistake; Burdick will enjoy the full force and resources of the fire union’s support in his quest for mayor. That means that every Valley fire union chapter (except Glendale for that would violate the federal Hatch Act) will donate to his campaign. All of these chapters will “volunteer” labor to put up his campaign signs (while helping opposing candidates’ signs to disappear or be vandalized) and droves of firefighters will walk the length and breadth of Glendale handing out pro-Burdick flyers. The big gorilla, the Phoenix chapter, will do the same in spades, in addition to making independent expenditures for campaign mailers. They want Burdick in as mayor…badly. Can you imagine the coup of having a former fire chief as the mayor of one of the largest cities in the state?

Again, Mr. Burdick is a nice man but you vote for him at your peril. Do you want a mayor who will advance the fire union’s agenda by pouring resources into the fire department at the expense of every other department in the city? The city only has so much money in its General Fund. Do you want your General Fund tax dollars being used for fire almost exclusively while ignoring libraries, parks, streets and a host of other essential needs?

Mayor Jerry Weiers will face a tough reelection. If he expects to prevail he had better get out into the community now. To this day many consider him invisible. He needs to up his public profile. Burdick is already hitting Weiers on the decision to cancel the Coyotes contract and to enter into a two year deal with them. That decision will play well with many voters because it reduced the burden on taxpayers considerably and they like that. Weiers still faces the possible specter of having Sherwood and/or Aldama run for mayor as well.

Burdick will receive a lot of help in his campaign. Don’t become mesmerized. He, like anyone else, has feet of clay. His associations with seemingly bad actors within Glendale government and his seeming inability to lead his own department are Burdick’s feet of clay.

Today, September 30, 2015, former Glendale Fire Chief Mark Burdick pulled a packet from the Glendale City Clerk’s office with the intent of running for the position of Mayor of Glendale in 2016. Burdick will, obviously, receive a majority of support in terms of campaign funding and manpower from the fire unions. As we have witnessed in the past, the fire unions will operate just a hair’s breadth inside campaign laws. Mayor Weiers is going to have a fight on his hands to retain his seat this coming election.

The Glendale Fire Department, kicking and screaming all the way, has finally implemented the use of a unit staffed with 2 persons, a paramedic and an emergency medical technician (EMT) to answer non-life threatening medical calls. It’s about time and the department is to be congratulated for implementing this test program. After all, it’s been in use in Mesa and Chandler for several years and is a proven system. It’s the first step in the elimination of the use of an engine or ladder answering medical calls…and is long overdue.

The first question that comes to mind is why would he deliberately demote himself? From the third largest fire department in the country to a much smaller department in Glendale? Apparently Mr. Garrison has been Fire Chief in Houston for the past 3 years and during that entire time his wife continued to live in the Phoenix Metro area. In his resignation letter his reason for leaving Houston is to assist in the care of an infant grandchild with a chronic condition. Many wonder if he will be the man to resist the continual pressure of the fire union power grab. We will find out shortly, won’t we?

A political committee, registered in Glendale, Glendale First! is sponsoring the recall of up to 4 June30-GlendaleFirst-Amendedcurrent Glendale city councilmembers: Vice Mayor Hugh, Councilmember Turner and Councilmember Tolmachoff (they have yet to pull a recall packet on Councilmember Aldama). These 4 councilmembers, along with Mayor Jerry Weiers, voted to cancel the Glendale arena’s lease management agreement with IceArizona.

On their website they say, “It is the opinion of Glendale First! that the recent actions of the Glendale City Council regarding their vote to cancel the arena management agreement with IceArizona (the Arizona Coyotes) was hasty, ill-conceived, politically motivated, and fiscally irresponsible.” They are angry about council’s action and for them it’s payback time. Revenge is a heck of a reason to mount recall elections. This is reason #1 and it is the major reason.

Obviously reason #1 for the recalls will not play well with Glendale’s residents and so, reason #2 is Glendale First’s accusation that these councilmembers did not support public safety. By public safety, don’t be confused – Glendale First! is referring exclusively to the Glendale Fire Department and more specifically the Glendale chapter of the fire union.

The Glendale police unions made it clear that they did not share Glendale First’s allegation. Justin Harris, president of the Glendale Law Enforcement Association, spoke at a recent city council meeting and recognized and thanked the city council for its continuing support of public safety. Then the Glendale Law Enforcement Association and the Glendale Fraternal Order of Police ran an ad publicly supporting the councilmembers under threat of Glendale First’s recall effort. As an aside, another ad was taken out by all of the opponents who ran against the sitting councilmembers in the last election. Their ad also supported these members of the city council and their vote to cancel the contract. Obviously the men and women of the Glendale Police Department did not support the allegations of Glendale First! – but the Glendale Fire Union did.

Make no mistake, the fire union wants more money and appears to have partnered with Glendale First! to try to make that happen. Their argument for more money rests on their claim of deteriorating fire department response times. Yet the former Glendale Fire Chief publicly stated the department’s response times have remained constant over the past five years. The fire department is accredited and their response time is one of the major criterions for successfully acquiring that accreditation.

The recent history of the fire department demonstrates the fire union’s tremenous influence within the department. During former Mayor Scruggs’ tenure she allied herself with John Holland, former president of the local fire union chapter. Because of her support of Holland and his union Glendale’s fire chiefs were reluctant to oppose the union’s desires and demands. The union grew in power and strength until today it virtually runs the fire department. It will be extremely difficult if not downright impossible for any Fire Chief, including Interim Fire Chief DeChant, to put the fire union genie back in the bottle. Yet that is what must be done to get the fire department back on track placing the needs of its citizens first.

So reason #2 of non support by council of public safety didn’t fly either. That led to reason #3 and their newest allegation, Glendale First! feels the City Council acted inappropriately when it reclassified the inter-fund advances used to fund payments to the NHL, essentially removing that nearly $40M liability from the City balance sheet with the stroke of a pen and a vote for the budget. In effect, what had been a loan from several enterprise funds was made to disappear with no requirement for repayment.”

Has that money and the promise to repay the Enterprise Funds disappeared as Glendale First! contends? No, it has not. Here is the real story as Paul Harvey would say. In 2011 and 2012 in an effort to keep the Coyotes in Glendale, city council agreed to the NHL demand of a payment of $25 million a year. Funds to make the NHL payments were borrowed from the Enterprise Funds and were recorded on Glendale’s ledger as long-term borrowing and became new debt owed to: Water & Sewer, Landfill and Sanitation. It added even more debt to Glendale’s bottom line and was recognized as such by the bond rating companies. They considered this debt as another long term liability for the city.

The action city council took was to approve renaming this debt from the term “inter-fund advance” to “inter–fund transfer.” It’s no more than an accounting trick. By renaming this debt it had the accounting effect of removing it as a debt (even though it still exists as a debt) which in turn, satisfied the bond rating companies and provided them with a rationale to raise Glendale’s bond rating profile. They did not dismiss their obligation to pay this debt.

Is the debt still there and is it being paid off? You bet it is. At a recent April, 2015 workshop Councilmember Tolmachoff asked to bring forward a resolution to make the General Fund FY 2015-16 Inter fund transfer July 11, 2015inter-fund transfers to the Enterprise Funds part of the budget process each year. It resulted in a City council approved Resolution 4943 New Series on May 26, 2015 making the inter-fund transfers to the Enterprise Funds permanent. Each year the city council will decide what the monetary amount of the inter-fund transfer to the Enterprise Funds will be. This Fiscal Year, 2015-16, the amount of the inter-fund transfer to the Enterprise Funds approved by the city council located on page iv within this year’s budget is in the amount of $600,000.

Glendale First’s reason #3 against these councilmembers which was that they had made the loan from the Enterprise Funds vanish is simply not accurate. The money did not disappear nor did the city’s commitment to repay the Enterprise Funds. It appears as if Glendale First! will have to get creative and come up with a new reason for recall of the councilmembers.

We can strike Glendale First’s reason #2 of council’s non support of public safety.

We can strike Glendale First’s reason #3 of council’s action to make money disappear.

That leaves Glendale First! with only publicly stated reason #1 left – the council cancelled the Coyotes contract.

It has been 17 years and 175 days since the city’s pledge to build the West Branch Library.

Sometimes Glendale city council meetings can only be described as mind boggling and l-o-n-g. The June 23, 2015 meeting was nearly 5 hours in length. Here is the link: http://glendale-az.granicus.com/MediaPlayer.php?view_id=2&clip_id=2305 .

Public comment has once again has been placed at the front of the meeting. There were many citizen speakers that night. To a man/woman all spoke in support of the four city councilmembers who may face recall: Councilmembers Aldama, Hugh, Tolmachoff and Turner. Some of the speakers were notable and recounted below. 

It’s important to note there are two, distinctly separate recall efforts occurring in Glendale. One is the recall election of Councilmember Gary Sherwood with that election already scheduled for November 3, 2015 in the Sahuaro district only. The reasons for his recall are unrelated to the recent vote to cancel the Coyotes contract and are best summed up by the Recall Councilman Gary Sherwood Committee at this link: http://www.stopsherwood.com/index.html .

The most recent media reports of recalls center around the councilmembers who voted to cancel the arena lease management agreement with IceArizona, owners of the Coyotes. It’s a totally different situation and the two recall actions should not be confused or lumped together. Very recent recall packets have been taken out on 2 of the councilmembers thus far, Councilmember Tolmachoff and Councilmember Turner. The petition packets have not been turned into the city as the group has just begun its effort and have until October 7, 2015 to turn in recall petition signatures. Glendale First is the sponsoring organization cited on these two political committee filings. Larry Feiner, a Glendale resident of the Cholla district, is one of Glendale First’s spokespersons and he is also involved in Desert Hockey Development with Bea Wyatt and George Fallar. Mr. Feiner and Ms. Wyatt seem to be the two main spokespersons for this latest series of recalls. Even though the sponsoring organization is Glendale First, Glendale residents and hockey fans residing within specific districts filed the organizational political committee paperwork. In this case, Bill and Jennifer Eikost, residents of the Glendale Cholla district, filed as a political committee and pulled the recall packet on Tolmachoff. Ben Shroyer and Paul Miller, residents of the Sahuaro district, did the same on Turner. Make no mistake. These folks are integral members of an avid Coyote fan base and have been involved with Glendale First since its inception.

Glendale First, led by Bea Wyatt and George Fallar of Cave Creek, is angry because in a majority vote of 5 to 2 this council voted to cancel the annual $15M lease management contract with the Coyotes. It raises the possibility of the team’s possible relocation elsewhere after all litigation is resolved. Obviously Glendale First dare not use as its sole reason for recall its anger with this council vote when a recent poll showed that over 50% of Glendale’s residents support the council’s action. So they have manufactured another reason. Their smoke screen reason is that council did not reduce the amount of money going into the city’s unappropriated fund balance (rainy day fund). They contend the money should be used for public safety immediately.

By public safety let’s call it what it is…the fire union. Fire wants more money and lots of it. They point to slow emergency response times but fail to mention two very important facts: 1. The Glendale Fire Department is accredited and meets that accreditation agency’s standards for response times, and 2. Call volume has increased due to the Valley’s Automatic Aid system. Quite simply Glendale fire responds to more calls in neighboring cities such as Peoria and Phoenix than the number of times those cities respond to calls in Glendale. Automatic Aid is placing a strain on the Glendale Fire Department and is partially responsible for the unavailability of Glendale fire units to respond to its own residents in a timely manner.

One of the citizen speakers of note was Gary Hirsch, a Glendale resident and former candidate for city council. With regard to the possible 4 councilmember recall he referred to a special interest group, Glendale First, as the sponsoring organization of the effort but the majority of his remarks were directed to the issue of the first original recall effort against Councilmember

Gary Sherwood. He said, “There are times that the official conduct of the councilmembers has proven to be so egregious that recall is not only appropriate but is necessary to restore honest representation. As a result the recall Gary Sherwood election has been approved and scheduled to take place on November 3rd, 2015.” He ended with this remark, “Always watch your wallet around Councilmember Sherwood.”Another speaker of note during the public comment period was Justin Harris. His remarks are below verbatim and were directed at the most recent issue of a second set of recalls of 2 (or 4) councilmembers sponsored by Glendale First:

“My name is Justin Harris. I am president of the Glendale Law Enforcement Association and co-chair of the Glendale Police Officer Coalition. I’m here tonight speaking on behalf of my members as well as Julie Pendergast. She could not be here tonight. She had personal matters to attend to. (Note: Julie Pendergast is president of the Glendale chapter of the Fraternal Order of Police and co-chair of the Glendale Police Officer Coalition).

“I find myself in an awkward position. Typically, we don’t come out speaking to the council regarding some of the events that have taken place. But I felt compelled to after some recent media events and some misinformation and misrepresentation of the facts that members of

Glendale First have shared with the public both in the paper and in the media. Recently I learned of the recall petitions that were pulled against Bart Turner. That was filed by Lawrence Feiner. The recall petition against Lauren Tolmachoff was pulled by Bill Eikost and Jennifer Eikost. I’m assuming they are husband and wife.

“What concerned me the most was part of the petition and the way it was worded. If they’ve got issues with what some of the councilmembers did regarding the Coyotes that’s their deal. But what I don’t appreciate is Glendale First coming in, misrepresenting facts saying that the mayor and certain councilmembers do not support public safety. In their filing they say that

you guys have diverted money earmarked for public safety and you placed that into a rainy day fund which has increased emergency response times. I’m not sure where they got their information but they sure didn’t come talk to me or my co-chair Julie Pendergast. Interesting enough, both Lawrence and Jennifer are listed as guests with Glendale First on a roster that attended a hockey game April 26th, 2013, at the Glendale arena in the city suite and the host of that event was Gary Sherwood – Councilmember Sherwood. (Please note: I, too, was in that suite on that date).

“Bea Wyatt, also with Glendale First, I listened to a radio talk show interview that she did on Friday, June 19th. She was talking about pulling recall petitions possibly on you, mayor and the other four councilmembers because they were not supportive of public safety. But then her comments bled into the Coyotes team. I don’t know why she was on sports radio talking about Councilmembers Turner and Tolmachoff not supporting public safety. I couldn’t tie the two together. Interesting enough the five councilmembers that voted to not renew the contract are the same councilmembers that this Glendale First is trying to attack and misrepresent facts about not supporting public safety.

“I’m here to tell the public today as being the person who represents the line level men and women who wear the badge. Mayor Weiers, Vice Mayor Hugh, Councilmember Tolmachoff, Councilmember Aldama, Councilmember Turner, you do support public safety. You made the tough decisions. There was a period of time prior to Proposition 457 when our members were giving concessions. We were understaffed to the tune of ten million dollars – understaffed, overworked. Our men and women went out there and did the job we took an oath to do. Meanwhile the city was forking over twenty five million dollars a year to a hockey team. Doesn’t make sense to me.

“So at this time I wanted to thank you Mayor, Vice Mayor Hugh, Councilmember Tolmachoff, Councilmember Aldama, Councilmember Turner for your unwavering support in making a very tough decision, finding the courage it takes to insure that you’re doing the right thing, not only for your constituents but also for your police department, the men and women who put our lives on the line every day to protect the public. Thank you for protecting us. I also wanted to thank each of you for upholding the state law and at least having the courage to have that law looked into to find out if there was in fact a conflict of interest at the time that the deal was done. It takes a lot of courage. You don’t see that too often. So, again, thank you.

“I’ve been sitting back like a lion in the tall grass, just waiting, watching and analyzing as these events have unfolded. But now I have come out to protect my members and to protect the city from a special interest groups that doesn’t care about public safety and they want to use public safety as a reason why they’re pulling this recall – or part of the reason they’re pulling this recall.

“I want each of you to be aware and the public to not support the recall against Councilmember Tolmachoff and Councilmember Turner because it’s misrepresentation of the facts. It’s half truths and they are flat out lies. We know that you are protecting public safety. We appreciate your service to the community and the commitment to your police department. Thank you.”

There were 86 items on that night’s agenda but the one that caused extraordinary public participation was Item # 83 Rezoning (ZON) application Zon 15-03 (ordinance): Palm Canyon Business Park Planned Area Development – 17750 N. 83rd Avenue – the Becker Billboard issue – again. A presentation was made by Mark Becker with the same arguments as when he was previously denied by this council. He added a few paid experts to speak about how innocuous billboards are.

There was one speaker, Glendale resident Connie Keiser, who nicely summed up the feelings of all of the citizenry that came out to speak against the billboards. She said, “Hello. I am Connie Keiser. I live in Glendale. I live in the Sahuaro district and I am impacted by these billboards. First off, I live in Hidden Manor and we were there long before Glendale because you annexed us. We are the subdivision directly north of Arrowhead Towne Center. We are the closest residential subdivision to those billboards.

“Digital billboards are the junk mail of the freeways. No one wants to be looking at a huge TV on a stick that distracts drivers and throws huge amounts of light into neighboring homes and

the night sky. That’s the reason Scottsdale and Paradise Valley will not allow billboards. They consider them to be junk.

“Why does Mark Becker keep beating this dead horse? I am sorry that people made a bad, bad investment in that property. When they bought that land they had the mistaken belief that they could fly in under the radar and could get billboards approved before we knew what hit us. Not in our neighborhoods. You can’t, Mr. Becker. You woke several sleeping giants and not only in Glendale but in Peoria. You did not expect us to come together as a community like we have.

Mr. Becker had been told ‘no’ over and over again but he hasn’t caught on yet. Now I have, if you’ll remember in his little presentation that he used, ‘Scenic America’ is one example. But he forgot to tell you about the ‘drop down’ on billboards which I happened to point out today. And I’m just going to quote several little things they say (Scenic America) about billboards.

“‘Billboards endanger health and safety. While the industry would like you to think billboards are harmless, their negative effects on health and safety have been well documented. Billboards hamper economic growth. Billboards make a few people a lot of money. Unfortunately, however, they do serious economic harm to communities. Nature of the billboard industry – the billboard industry likes to proclaim its small, local nature.’ We heard Mr. Becker talk about how he’s just a small, local company. ‘When a state or local government considers enacting tougher billboard controls industry lawyers and lobbyists appear at hearings and speak long and loudly about how the government is threatening another small business with extinction.’ The reality, however, is quite different.

“We don’t need these billboards. I’ve been here, I think I told Planning and Zoning I got notified by Social Security I have a life expectancy of 20 years and I will keep coming back for those 20 years to fight this horrible, horrible idea. Please tell him ‘no’ unanimously just like Planning and Zoning has done. Thank you.”

After Becker’s presentation and the public hearing it was council’s turn and a theater of the absurd ensued. Mayor Weiers asked City Attorney Bailey and it was confirmed the order of proceeding would be amendments to the motion would be considered and voted upon first. That action would be followed by a consideration and a vote upon the applicant’s zoning request with any new amendments that council would have just approved.

Well, it didn’t go that way at all. Councilmember Chavira asked to make his motion first. Instead of offering the amendments only and exclusively, Sammy’s motion included approval of the applicant’s zoning request along with his self crafted 4 amendments. Aldama seconded the motion with amendments. The instruction for action that had just been outlined so carefully went completely out the window. It appears that Sammy is not always the brightest bulb in the pack.

Mayor Weiers asked if there were copies of the newly offered Chavira amendments available. City staff did not have any copies but immediately Mark Becker popped up and passed out copies of the Chavira amendments to staff for distribution to council. Wait, you ask, why does Mark Becker have copies of the Chavira amendments but city staff and the rest of council do not? Immediately the question comes to mind – who really wrote those amendments?

Councilmember Tolmachoff must have had the same thought for she asked who prepared the amendments – Mark Becker or Councilmember Chavira? Councilmember Chavira responded by saying it was his motion and he came up with the amendments that very same day. Why did he make sure Mark Becker got copies yet didn’t distribute them to staff and city council for their advance consideration prior to the meeting that evening? It makes no sense.

All of the councilmembers with the exception of Councilmember Sherwood and Vice Mayor Hugh commented prior to their votes. The most disturbing commentary to the anti-billboard people in attendance were the remarks made by Councilmember Turner. It seemed as if he was about to vote in favor of the billboard application and a majority of the audience was visibly shaken for it appeared as if he would become the fourth and majority vote granting the Becker billboard application. He said that the applicant’s request was similar to the billboards that had been approved for the Westgate area and since the Loop 101/Bell Road corridor was similar in commercial nature to the Westgate area it should be considered similarly in that context.

Mayor Weiers asked the city attorney again if Chavira’s motion including the amendments was valid. Mr. Bailey indicated it was a valid motion and recited for clarification what the motion included. Mayor Weiers proceeded with a roll call vote typically done in alphabetical order of councilmember surnames. Councilmember Aldama and Councilmember Chavira voted in favor of the billboard application. Councilmember Sherwood passed. Never, ever in my 16 years as a councilmember had any councilmember ever passed on a vote. Why did Sherwood do it? Why on this night? Think about it. Two councilmembers had voted in favor. Sherwood knew he could vote in favor as well but he needed to know what Councilmember Turner’s vote was before he voted for or against. If Turner voted in favor Sherwood would be the fourth and majority vote for passage of the billboard application. So he passed, waiting to hear what Turner’s vote would be. Councilmember Tolmachoff and Vice Mayor Hugh voted against the billboard application.

The vote was 2-2 and it was Turner’s turn. There was a moment of hesitation and then he voted against the billboard application. Weiers passed and went back to Sherwood for his vote. Sherwood voted against the billboard application and why not? He knew the motion was defeated and by flip flopping once again and voting against the billboards it might provide him some cover for his recall election. The last vote was cast by Mayor Weiers against the billboard application with the result being a 5-2 vote with only Aldama and Chavira supporting the request. Do you suppose they were blindsided by their buddy Sherwood? Do you think they will trust his word from now on?

City council vacates the month of July and will return to regular order in August. Many schedule vacations during July but they may find themselves called back to town to participate in depositions regarding the Coyote litigation. Glendale residents need a break from the ongoing political shenanigans too.

It has been 17 years and 146 days since the city’s pledge to build the West Branch Library.

I salute the men and women of the Glendale Fire Department. You, time after time, demonstrate your compassion, professionalism and integrity every time you answer an emergency call. Your genuine care for the people you serve is evident…especially the children, the little ones. Thank you for your service. I and every Glendale citizen appreciate what you do.

You work hard but you are paid well for your knowledge and expertise. You probably think that it is not enough and perhaps it isn’t. Due to your schedule of one day on and two days off many of you have second jobs or are business owners. It is something that nearly every other employee working a traditional 5 day a week job does not have the luxury of doing.

As a former councilmember and now private citizen of Glendale whatever concerns I have had or do have about the policies of fire service delivery have never been about you but they have been about the union that represents you and some of the goals and the tactics the union uses.

 I go nuts when in reviewing fire’s pay for major events such as this past Super Bowl and I see some fire department employees earning $220 an hour in overtime pay. I’m sorry but I think that is outrageous. There are many other professions in which their members earn far less than $220 an hour in overtime pay. It breeds a lack of sympathy among the general public.

The Glendale fire union’s latest stunt was averted by councilmembers who realized the fragility of Glendale’s current budget situation at their city council meeting of May 26, 2015. Sherwood and Chavira pressed to use reserve funds but they did not prevail. Sherwood is supportive because he needs all the help he can get in facing his recall election. Chavira is a Phoenix firefighter and has an obligation to support anything the fire union wants.

When Glendale residents picked up the Glendale Republic of May 23, 2015 the headline screamed Fire department understaffing stirs concerns in an article by Matthew Casey. It reflected a deliberate strategy by Joe Hester, President of the Glendale chapter of the fire union, (who really runs the department) to use scare tactics to get additional revenue now…immediately…to expand the fire department. Hester said, “It seems pretty obvious there is a crisis by any way you measure it. The most telling statistic in the article was provided by Glendale Fire Chief Mark Burdick. He offered Glendale Fire Department response times for 90 percent of calls by year:

  • 2010 8 minutes 11 seconds
  • 2011 8 minutes 10 seconds
  • 2012 8 minutes 6 seconds
  • 2013 8 minutes 12 seconds
  • 2014 8 minutes 12 seconds

So where is the crisis? Today’s response time is the same response time as in the previous 5 years. Another fact often ignored is that Glendale is one of ten cities in the state accredited by the non-profit organization, The Center for Public Safety Excellence. Glendale would not have received its accreditation if its response times were not acceptable. This agency is responsible for accrediting individuals and agencies internationally. It is a much coveted accreditation and Glendale is proud to have measured up to its criteria. Do you really think Glendale would have received its accreditation if its response times were not acceptable?

The statistic Chief Burdick provided is telling for another reason. Now that he is soon-to-be retired as Fire Chief he has begun to tell it like it is. As a councilmember 5 or 6 years ago Chief Burdick and I had a conversation about the union and its influence within the department. There was much he wanted to say but he was obviously reluctant to speak freely about the union and its influence and he refrained. I could sense that he was embarrassed that he could not speak freely.

The purpose of this article released just before the council meeting was to pressure the city council to change its budget strategy and to use general fund contingency or unappropriated fund balance to purchase more equipment and to hire more personnel immediately.  Let’s look at some facts not clearly addressed in the article:

  • Fact #1 – Glendale is experiencing an increased call volume. Why? Glendale’s population has barely increased and in fact, Glendale is anticipated to lose state shared revenue because its population growth is low compared to other Valley cities. Much of its increased call volume are responses due to Automatic Aid.
  • Fact #2 – Glendale is a member of the Valley-wide automatic aid system. If the closest fire station is busy and Glendale is the next closest, Glendale is dispatched to handle the call out of its city. The Republic article acknowledged that “Glendale responded about 3,300 more times to calls in Phoenix and Peoria than those cities responded to Glendale combined.
  • Fact #3 – Glendale uses overtime to make up for its increased call volume. It is insane to send a large truck with 4 personnel to medical calls when 80% to 90% of its calls are medical. There are other strategies such as 2 person ambulances being employed right now, this very minute, to respond to emergency medical calls. It’s time for Glendale to adopt one of them.

Shame on the fire union for attempting to scare people into giving them the financial resources they want right now.  Shame on the fire union for attempting to expand its empire rather than looking at other strategies for response to medical calls.

No one asked the question: The fire department’s budget comes from the city’s general fund. It has been acknowledged that they want an additional $2 to $3 million and that does not include the additional monies needed to pay the salaries and benefits for more personnel annually. What department in the general fund do they want to cut by $2 to $3 million? What other city service are they willing to sacrifice to meet their needs right now?

In response over the next few months the council will take a measured look at the entire issue of adequate resources for public safety and that includes the police department. Five of the councilmembers did not rush to judgment as Sherwood and Chavira pressed them to do.  They realize that there is a problem but they were not ready to sacrifice other city services to give the fire union what it demanded. They also realize that there is no quick fix. It will take several years to implement a viable solution. The men and women of the Glendale fire department want what is best for their city. Too bad their union is not listening to them.

On Monday, March 16, 2015 the Glendale city council held a special workshop meeting. The only agenda item was the Public Safety Personnel Retirement System (PSPRC). There were 4 presenters: Brian Jeffries, President of the Professional Firefighters of Arizona (PFFA); Scott McCarty, representing the Arizona League of Cities and Towns Pension Reform Task Force; Justin Harris, President of the Glendale Law Enforcement Association (GLEA) and Secretary of the Arizona Police Officers Association (APOA); and Julie Pendergast, President of the Glendale Chapter of the Arizona Fraternal Order of Police (Glendale FOP) and Co-Chair of the Glendale Law Enforcement Coalition (GLEA +GFOP).

Mr. Jeffries (PFFA) began with a 35 minute presentation of the history and background of the PSPRC; legal challenges as a result of SB 1609 passed by the Arizona Legislature in 2014; and the state fire union’s call for a constitutional amendment to the state constitution. Mr. Jeffries was articulate and offered a slick presentation. One can appreciate why he is the president of the state fire union.

He acknowledged as their partners in seeking a constitutional amendment several law firms hired by the union; TriAdvocates hired by the union as their communications arm; the Fire Chiefs Union and the Fire Districts Association; and last but not least, the Fraternal Order of Police, the Arizona Police Association and the Arizona Highway Patrol Association.

He did clarify at one point, that while law enforcement had attended fire’s meetings on the issue of pension reform it was there to observe rather than as an active participant.

In essence, Jeffries was asking for council to sign on as a supporter of their constitutional amendment proposal. Their fire referendum’s basic language states, “The benefits of the beneficiaries shall neither be diminished nor impaired except for the provisions on Bill xxxx (sic), as passed by the legislature in 2014.” I don’t pretend to be an expert on SB 1609 and its provisions but it appears as if the fire union really, really wants this bill – to the extent that they want it to be a constitutional amendment. They don’t appear to be interested in true pension reform.

There have been lawsuits filed against SB 1609 and in the Harris case, one provision relating to retiree benefits has been struck down successfully. Another case, the Hall case relating to active personnel benefits, looks like it, too, will be struck down successfully.

Despite those provisions being removed the fire union still wants this bill to remain in perpetuity. Jeffries threw down the gauntlet when he proclaimed that the fire union wanted action now and were prepared to mount a statewide referendum campaign to get it on the ballot this year. We should all be asking, why the rush? Next year, 2016, there will be a presidential election and it could be on the ballot at that time. Instead they are ready to fund it and run it as a full, political operation with TV advertising, direct mail and a statewide grassroots effort – now, right now. The question remains, why?

The next presenter, Scott McCarty represents the Arizona League of Cities and Towns. The league, last June, put together a task force on pension reform. The League is taking a measured approach and is currently preparing a Draft Yardstick of pension reform goals, measurements and outcomes. In May or June of this year, they will compare the fire union’s proposal against their Draft Yardstick and by August, 2015 they will present their proposal for pension reform along with their findings of the fire union proposal to all participating cities at their Annual League Meeting.

Last up were Justin Harris (GLEA) and Julie Pendergast (Glendale FOP). Mr. Harris spoke on behalf of both Glendale police unions. He disputed Jefferies’ assertions that the police were on board by unequivocally stating, “The police union is not working in ‘concert’ with the fire union.” He went on to say, “Currently the police union is at odds with the fire union over an agreeable solution.” He said, “The police union wants a plan that is legitimate, legal and long standing.” If Mr. Jeffries’ statements about police union support for this constitutional amendment were in fact, misstatements, what else in his presentation was a misstatement?

Mayor Weiers made some interesting comments. He explained that at the time SB 1069 was introduced, he was Chair of the House Rules Committee. Upon legal advice he came to the opinion that SB 1069 was unconstitutional and would face legal challenges. Kirk Adams was former House Speaker and fully supported SB 1069. In essence, Mayor Weiers said Adams threatened him with removal of his chairmanship if he did not pass SB 1069 out of committee. Weiers acceded.

Weiers also stated that Mike Colletto of the Professional Fire Fighters Association was opposed to the bill but eventually caved and joined in signing off on it. It just so happens that Kirk Adams is Chief of Staff for newly elected Governor Doug Ducey. So don’t be surprised if the fire union effort eventually receives an endorsement from the Governor’s office.

Mayor Weiers then asked Acting City Manager Dick Bowers if this agenda item was informational or required direction because…he and the rest of council had received an email from…you, guessed it…Councilmember Gary Sherwood…asking that council give direction to place this item on an evening voting meeting agenda so that council could support the fire union’s proposed statewide referendum. Doesn’t Sherwood ever quit?

Councilmember Chavira, a firefighter for Phoenix, just couldn’t stand Mayor Weiers’ characterization of his self proclaimed mentor, Mike Colletto and said, “I never saw Mike Colleto cave on anything.” After thanking Jeffries profusely for his “complete presentation” (he almost said “complex”) he then went on to chide the council by stating the need for “solidarity” between the two unions implying that shamefully the police unions were not standing toe to toe with their brother union.

The most important lesson coming out of this informational presentation is that cooler heads…a majority of them…prevail. Those cooler heads are willing to take the time necessary to come up with public safety pension reform, built on compromise, that will stand up to legal challenge and last over time. The fire union’s proposed constitutional amendment speaks to a hidden agenda…what do you think it is?

March 19, 2015….17 years and 78 days without a West Branch Library

Please note: From now on my header will contain the length of time West Glendale has been waiting for its long promised library.

It’s only been a few weeks since former City Manager Brenda Fischer resigned and her “publicists” remain hard at work. I have no doubt there will be more positive stories planted in the local media about the “great job” Fischer did in her 17 months in Glendale.

On March 13, 2015 Eric Jay Toll authored an article entitled “The two sides of the Fischer-Weiers split” in the Phoenix Business Journal. Unfortunately unless one has a paid subscription one cannot read the entire article as the website only posts a paragraph or two. As luck would have it, my neighbor does subscribe and gave me his copy.

There was one very notable quote in the article. “Brenda Fischer was good to employees, and she was good for business in the city,” said Glendale Firefighters Association President Joe Hester. “When she left, it was an extreme disappointment. I’ve worked with a number of city managers and she was the first one I’ve worked with who was fully transparent, operated with integrity and had a word that could be trusted.”

Is Joe Hester implying that Interim City Manager Dick Bowers is not “fully transparent,” does not “operate with integrity” and his word is not to “be trusted?” After all, Hester states categorically that she was the first city manger that he worked with who embodied those qualities. Dick Bowers, former City Manager of Scottsdale for many years, is a person with an impeccable reputation of the utmost integrity, transparency and trust. If I were Mr. Bowers I would be none too happy with Mr. Hester’s remarks.

Hester has only been President of the Glendale Firefighters Association for a few years. As president of the union he did not work with Dr. Martin Vanacour, Glendale’s City Manager from 1985 to 2001. If he worked with Glendale’s next City Manager from 2001 to 2012, Ed Beasley, it was for a very brief time prior to Beasley’s departure. So who did Hester work with? That leaves Horatio Skeete, City Manager for about 4 or 5 months in 2012; Dick Bowers for approximately 8 months in 2012 to 2013; Brenda Fischer for 17 months from 2013 to 2015; and now Dick Bowers again. It appears that the number of city managers with whom Hester has worked is three. His characterization of a “number of city managers” would lead one to believe that there have been scads of them. Hmmm.

Then again, of course Mr. Hester was delighted to have Fischer as Glendale’s city manager and why not? Ms. Fischer’s husband was, and may still be for all I know, a firefighter in Henderson, Nevada. It is understandable that Ms. Fischer’s natural bias would be in favor of the firefighters. Wouldn’t Hester feel he had a sympathetic ear when it came to firefighter goals and issues?

Mr. Hester also stated that Ms. Fischer was “good for business in the city.” Perhaps he should have checked with Robert Heidt Jr., President and CEO of the Glendale Chamber of Commerce. I don’t think anyone has forgotten Ms. Fischer’s temper tantrum directed at Mr. Heidt at the Yard House restaurant…a very public place.

Mr. Toll’s headline for his article, “The two sides of the Fischer-Weiers split” implies that Mayor Weiers was responsible for her leaving. Not so. Ms. Fischer was capable of causing it all on her own. Her actions including promoting Julie Frisoni as Assistant City Manager when she was unqualified for the position at the time; her very public berating of the Glendale Chamber President; her perceived advocacy for one councilmember’s (Gary Sherwood) agenda; and her brazen request for three sitting councilmember’s emails were more than enough to sour a majority of council on her leadership.

Many have come to the conclusion that Ms. Fischer orchestrated her own demise as Glendale’s city manager.
